All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Carolyn Shank carolynshank@msn.com April 29, 2007, 6:10 pm Source: Personal Record Written: 1853 THOMAS ROGERS Last will & Testament In the name of God, Amen, I THOMAS ROGERS of the County of Union and State of North Carolina calling to mind the certainty of death and the frailty of human life and being now considerably advanced in years, yet of sufficient strength of body & mind to dispose of what Earthy Goods it has pleased God to bless me with, do hereby make, publish and declare this my last will & testament hereby revoking & making null and void all other last wills & testaments made by me. Imprimas After my death and burial (which I want done in a Christian like manner suitable to the wishes of my family & friends, I desire my Executor hereinafter appointed to pay off and discharge the expenses of my burial and such other necessary expenses and just debts (if any) out of the first money which may come into their hands by virtue of their Office. Item 1st I will & bequeath to my beloved wife, WINNY, one Negro girl aged now about fourteen years named CATE to have and to hold during her natural life -- Also one horse (the Grey), one horse cart & gear, two cows and calves if any have calves (her choice), ten head of hogs (her choice) all my stock of sheep that may be on hand at my death, all the Kitchen furniture, also all the household furniture includinng Beds & their necessary furniture & bedsteads, Tables, Chairs, Earthenware, clocks, and all such articles as usually belong to the house . Also, I give to my dear wife one year's provisions out of the crop and provisions on hand if there is enough of such to make for herself, her Negro, horse, stock a year's support, such allowance to be made by three disinterested persons chosen by my Executors. Item 2nd I will & bequeath to my dear wife WINNY & foregoing property the land on which I now live, bounded as follows: Beginning on the three Notched roade a little west of a new field cleared in 1852 & 1853 & then run so as to leave her said field to a corner of the original dwelling house, then down the flat branch so as to give her all the land East of said line & North of the three notched road supposed to contain two or three hundred acres to have during her natural life. Item 3rd All the balance of my property viz. about one hundred acres, land joining the lands of RUSSEL ROGERS on which RUSHING ROGERS lives & RICHARD ROGERS lands and the following Negro slaves viz. ADAM, ELIJAH, BILL, HANNAH, AMANDA and NANCY together with increase (if any) and all my cattle & hogs, horse and everything not otherwise disposed of, I wish and it is my will for it to be sold to the highest bidder on such credit as my Executors may think necessary in their discretion to give and the said proceeds of said land and Negros and other property so sold to be equally divided between my sons viz. RICHARD, RUSHING, RUSSELL, SHEPHERD, AARON, CALVIN, JAMES M, JASON, and COMODORE and the children of THOMAS P. ROGERS, such children to be entitled to the share which their father would have been entitled to were he alive. Item 4th To ROBINSON ROGERS I only will and bequeath one dollar having paid debt for him as much or more than what I concieve would be his equal share of my property. Item 5th I will and bequeath to my daughter RODA intermarried with ARTHUR SIKES and WINNY, intermarried with ISAAC ELLIOTT, each the same of one dollar and no more having heretofore given to each of them a Negro, a bed, cow & calf, and other property. Item 6th All the property herein will and given to my beloved wife WINNY Land & Negro Girl, Horse, Cattle, Hogs, & Sheep, Household and Kitchen furniture, Horse Cart and other articles inhereby given to her during her natural life and at her death to be sold with the increase of it (if any) by my Executors in the manner heretofore prescribed for the sale of other property and the proceeds of it to be divided among the same persons heretofore mentioned who were to have the proceeds of my other property viz. RICHARD, RUSHING, RUSSEL, SHEPHEARD, AARON, CALVIN, JAMES M., JASON and COMODORE ROGERS, and the children of THOMAS P. ROGERS they receiving that portion which would have been their Father's were he alive. Lastly, I hereby nominate and appoint my son RUSSEL ROGERS and friend D.A. COVINGTON Executors to this my last will and testament -- hereby revoking all former last wills & testaments by me made. It just occurs to my mind before signing this will that I have omitted to give my son COMODORE ROGERS a tract of land in this County on the head waters of Flag Branch adjoining the lands of BURTON LANEY, the heirs of MOSES EASON & others containing about 200 acres which land I hereby give to my son, COMODORE ROGERS, his heirs and assigns forever.
