Union County, NC - Will of Cullen Smith, 1858 ~~~~~~~~~~~~~~~~~~~~~~~~~~ Will of Cullen Smith of Union Co. NC In the name of god Amen I Cullin Smith of the County of Union and state of North Carolina being of Sound mind and memory and Considering the uncertainty of this frail and transitiory life Do therefore make ordain publish and Declare this to be my last Will and testament that is to say First after all my lawful Debts are paid and Discharged the Residue of my Estate Real and personal I give and bequeath and Dispose of as follows Viz to my beloved Wife PATIENCE the land and appurtenances situated thereon known and Described as the home tract whereon I now live laying in the county of Union and state of nor carolina together with the house hold furniture and live Stock of Every Description now possed by me During the term of her Natural Life or widow hood and after her Death or marriage to belong to my son J E W Smith to my son B B Smith the farm on which he now lives Containing one hundred & seventy five acres more or less which he has a title of Warranty for the Same and to son Stephen Smith I give & bequeath one dollar To my grand son ANDREW J. Smith I give and bequeath one dollar to my grand son CULLIN J SASSER I give & bequeath one dollar And also I and bequeath to my Daughter ESTHER who intermarried with ELISHA Sasser and the heirs begotten of boddy the tract of land on which she now lives Containing fifty acres adjoining the Lands of J.C. Mullis C Brook and others And also to my grand Daughter PATIENCE A SASSER I give and bequeath one bed bedstead and furniture and to my Son J E W Smith I give and bequeath a certain tract of land adjoining the land of J C Mullis Enis Staten and others Containing Seventy two acres and My other Seventy two acre tract of land adjoining the Wm Hamilton Mill tract to be sold and Equally Divided between my Daughter DORCAS Who intermarried with Jesse Baucom and my and my grand Daughter Patience A. Sasser and their boddily heirs share and share alike like wise I make Constitute and appoint my Said Son J E W Smith to be my Executor of this my last will and testament here by Revoking all former wills by me made In Witness Whereof I hereunto subscribe my name and affix my Seal the twenty Second Day of february in the year of our lord one thousand Eightteen and fifty eight Cullin Smith {Seal} The above written instrument was subscribed by the sd C Smith in our presents & acknowledged by him to Each of us and he at the same time published & Delivered the above instrument So Subscribed to be his last will & testament & we at Testators Request & in his presents have signed our names as witnesses hereto & written opposite our names J. C. Mullis Calvin Brooks Notes: 1. The wife of Cullen Smith was Patience Boyet, daughter of Shadrack Boyet and Martha Langston of Wayne Co. NC. Patience, age 83, is listed with her son-in-law and daughter Elisha and Esther (Smith) Sasser in the 1860 Union Co. NC census.. 2. Cullen Smith appears to be the Cullington of Collington Smith of the Wayne Co. NC 1800 census and is the Cullen Smith there in the 1810 census. 3. Land records indicate Cullen Smith moved to Anson Co. NC by 1816 where he appears in census records of 1820, 1830, 1840. He next appears in the 1850 Union Co. NC census by county formation. 4.
