Hays it will be recalled, was charged with killing Joseph Dement seven years ago. It developed at the the trial that Hays struck Dement with a rock while the latter was in the act of cutting him with a knife - in fact he had cut his clothing to pieces and was still pursuing him when the fatal blow was stricken. Dement lived several days after he was hit on the head with the rock. Hays ran away though being illy advised. He was nothing but a boy, being only about 17 years old at the time.
