Term 1863 JOHN P. COOK and others vs. JOHN F. ELLINGTON. Petition for division of slaves and settlement. This cause coming on to be heard, and appearing to the satisfaction of the court that JOHN C. AVERA, T. HINTON, and wife, ESTER, RANSOM HINTON, WILLIAM SPIVEY, JAMES SPIVEY, GRAY SPIVEY, ANN SPIVEY, JANE SPIVEY, AND FRANCIS SPIVEY are non-residents of this State, it is ordered that advertisement be made in the Raleigh Standard for six weeks for said defendants to appear at the next Term of this Court to answer, plead, or demur to this petition or judgment will be taken pro confesso as to them.
