NC Sept 2nd 1875 $400 land and notes, accounts and that Mary Jenks (the widow), Wm Jenks, John Jenks, Hinton Jenks, Ransom Jenks, Liddie Howard (or Harwood), wife of John Howard, Kittie Pasmore, wife of Thos Pasmore, Sarah Wimberly, wife of officiant (Matthew wimberly), are children of Seth Jenks. Mary F. Broadwell, Cadorum? Jenks, his grandchildren, all of whom reside in Wake Co and are of age except the last mentioned, who is about 16 years old. Matthew Wimberly. Jinks, Lydia Howard wife of John Howard, John Howard, Kitty Pasemore, Sarah Wimberly, wife of Mathew Wimberly, Priscilla Jinks, Mary Broadwell, Mary Jinks, Jr. Kadorum Jinks, Sarah Jinks The plaintiff alleges: That sometimes in the month of June 1872, Seth Jinks late of Wake County died leaving him surviving his widow the defendant, Mary Jinks Sr. and the defendants, William Jinks, John Jinks, Hinton Jinks, Ransom H. Jinks, Lydia Harwood, who previous to his death had intermarried with the defendant John Harwood, Kitty Pasemore who previous to his death had intermarried with Thomas Pasemoore since deceased, Sarah Wimberly who had previously intermarried with the plaintiff, Mathew Wimberly, and Allen Jinks and Caswell S. Jinks his children and Hendon? Jinks, a daughter of his son, Troy Jinks who pre-deceased his father the said Seth Jinks, his only heirs at law. That since the death of said Seth Jinks his son, the said Allen Jinks has also died [Nov 30, 1873] leaving him surviving his widow the defendant, Priscilla Jinks and Mary Broadwell his only child and heir at law. That since the death of said Seth Jinks his son the said Caswell S. Jinks has also died leaving him surviving his widow the defendant Mary Jinks and Kadorum Jinks his only child nd heir at law who is an infant about 16 years of age and lives somewhere in the state of Texas. Post Office or court unknown, the plaintiff and has no guardian. [Caswell Jenks estate: filed: Aug 26, 1875 widow Mary E. Jinks, child (didn't name child) Nov 18, 1878] Said Hendon Jinks, daughter of said son, Troy Jinks has died,[Gettysburg 1863 jul 1) having never married and whose only heirs at law is her mother the defendant Sarah Jinks who is the widow of said Troy Jinks. That about the (blank) day of (blank) 1873, letters of administration upon the estate of said Seth Jinks were duly granted & issued to Caswell S. Jinks by the Probate Court of Wake County and said Caswell S. Jinks duly qualified as such Administrator. That afterwards to wit sometime in the year 1875, the said Caswell S. Jinks died and on the day of August 1875, letters of Administration de bonis on upon the estate of said Seth Jinks were duly granted & issued by said Probate Court to the Plaintiff who duly qualified as such Administrator and took upon himself the burden of Administration. That said Caswell S. Jinks as Administrator as aforesaid took possession of the goods and clothes and credits and sold for assets? about 50 acres of the land of said interstate of said deceased and paid over to the said Mary Jinks widow as aforesaid her years allowance as allotted to her, but paid only a small amount of the debts of deceased. That this plaintiff has sued the Administratrix of said Caswell S. Jinks for a settlement of the affairs and dealings of said Caswell S. Jinks as Adm. with the estate of said Seth Jinks and recovered a judgement against her for the sum of Forty dollars and has collected said sum in money and paid the costs of said suit & attorneys fees out of the sum leaving in hand about eight (eighty?) dollars in money from this source and from money formerly collected from said Administration without suit. That this sum and about three hundred dollars in notes, which said notes are insolvent and uncollectible is all the personal estate that has come into the hands of the plaintiff as Administrator and is all that he has any knowledge of that belongs to the estate of his intestate. That the plaintiff has been unable to collect said notes and has applied the greater portion of said money which came into his hands to the payment of the debts of his intestate but that there are outstanding claims against the estate of his intestate accounting, as well as plaintiff has been able to ascertain to something over one thousand dollars. And that it will be necessary to sell the lands belonging to the estate of his intestate to satisfy said debts & the cost & charges of Administration. That said Seth Jinks was seized and owner in fee at the time of his death, of two tracts of land in Wake county, one known as the Panther Creek tract containing about fifty four acres and adjoining the land of Busbee Scotal? Bennett Batchelor, T.Wm Notes, and the other known as the Nat Cox place near the town of Apex adjoining the lands of Guilford Lewis, Wm Leiws, Geo W. Atkinson & others containing about one hundred acres; which is worth about four dollars per acres, and that the forty four acre tract was sold for assets? as aforesaid by said C.S. Jinks as Administrator and title made to the purchaser Wm Notes. (yates?) That the defendant Mary Jinks, Sr. the widow of the said Seth Jinks is entitled to dower in the lands of said Seth and the same has not been allotted to her......
