STOCKTON Vs. JOSEPH WEISMAN and others. Pursuant to an order made at Fall Term 1858 of the Court of Equity for the County of Wake, in the above entitled course, the undersigned, Clerk and Master in Equity will proceed to sell at the Court House door in the City of Raleigh, on the first Monday after the fourth Monday in March next, the land in the pleadings described, to wit. an undivided fourth part of the following tracts of land: 1st. A tract of land called the COOK tract containing 460 acres, which RICHARD SMITH purchased of JAMES H. COOKE, under deed bearing date of December 1842. 2nd. A tract of land called the SAUNDERS tract containing 82-1/2 acres purchased by SMITH of R.M. SAUNDERS, under deed bearing the date of 17th of July, 1844. 3rd. A tract of land called the COLLINS tract, containing 537-3/4 acres purchased by said SMITH OF WILLIAM F. COLLINS. 4th. A tract of land called the HAYWOOD or HARRISON tract containing 468 acres purchased of WILLIAM A. HARRISON under deed bearing date of the 1st of March, 1843. 5th. A tract called the ROBOTEAN tract containing 50 acres, purchased of PERRIN BUSBEE, Clerk and Master in Equity, under deed bearing the date 25th of February 1843. 6th. Another tract called the MALONE tract, containing 176 acres purchased of CALEB MONROE under deed bearing date the 17th of January 1813 containing 55 acres. 7th. A tract called the FINCH tract, purchased of CHARLES E. FINCH, under deed bearing date the 25th of Sept. 1813 containing fifty-five acres. 8th. A tract called the JOHNS tract containing 700 acres purchased of JOHN B. JOHNS under deed bearing date the 22nd of June 1843. 9th. A tract called the SPIKES or JEFFREYS tract containing 240 acres, purchased of JAMES G. JEFFREYS, under deed bearing date the 8th of April 1843, in and to which tract the mining privilege, the privilege of taken timbers for props, and of the water power alone were purchased and the estate and privilege so purchased are alone intended to be sold. 10th. One tract called the McDADE or SNELLINGS tract, containing 130 acres, purchased partly of WILLIAM SNELLING under deed bearing date of 17th Oct. 1845. 11th. One tract called the STUART tract, containing 167 acres purchased of JOHN STUART under deed bearing date the 30th Sept. 1843. 12th. One tract called the HIGH tract containing 400 acres purchased of ELIZABETH HIGH, under deed bearing date of 25th of Feb. 1844. 13th. Also one half moiety of the estate and mining and other privileges on a tract of land called the MAY tract, purchased of WILLIAM MAY, under deed of lease bearing date the 11th of July 1845. 14th. Also the estate, mining and other privileges on one other tract containing 700 acres, purchased of WILLIAM HILL under deed bearing date the 1st July 1843. 15th. One tract called CANNON'S HEIRS tract, containing 256 acres purchased of PERRIN BUSBEE (Clerk and Master of Wake) under deed bearing date the 1st of July 1843. 16th. One tract called the ALFRED JONES tract containing in all 550 acres, purchased of ALFRED JONES and others under deed bearing date the 3rd of May 1843; and also under deed from J. G. WALKER and LOUISA E., his wife, bearing date the 14th of Feb. 1848. 17th. One tract called the HOLLISTER tract, containing 880 acres purchased of WES'LY HOLLISTER and GEORGE H. COIN, under deed bearing date 3rd Jan. 1848 The whole number of acres contained in said tracts being 5,956 acres, more or less, and the boundaries of each and all of said tracts being more particularly set forth in said deeds so executed as aforesaid to RICHARD SMITH. All the said lands and hereditaments being the same conveyed by RICHARD SMITH to JOSEPH WEISMAN and JAMES HEPBORN, and by them reconveyed to the sd. RICHARD SMITH by way of mortgage. Also conveyed by sd. SMITH'S devisees to WILLIAM H. WINDER and by him to the HERON Mining Company. TERMS OF SALE -- A credit of six months will be given purchasers upon their entering into bond with approved surety bearing interest from the day of sale. Five per cent of purchase money to be paid by cash. Given under my hand, at office, this 21st day of February A.D. 1859.
