Morgan botaus@aol.com July 12, 2010, 12:05 am Source: Wake County, Nc Estate Records - Martin To Maxwell, Lds Film 1638170 Frames 1274-8 Written: May 1814 State of North Carolina Wake County May Term 1814 To the Worshipful the Justice of the County Court aforesaid the Petition of John Massey , Samuel Massey, Jessie Olive & Monicai his wife Henry Massey Samuel Massey ye younger , Richard , Christian, Blakey & Dennis Massey infants under the age twenty one years by Jesse Olive their next friend. Humbly herewith _ That your Petitioners are the children & legal representatives of Richard Massey deceased, who departed this life some time in the year one thousand eight hundred & ____ -- Your Petitioners further state that at a court held for the county aforesaid in the month of 1812 , a certain paper writing said to be the last will & testament of said Richard Massey was offered for and admitted to probate at the court aforesaid -- Your Petitioners further show & expressly chare that the said paper writing was not the last will and testament of the said Richard Massey -- that at the time of the making thereof he was unable to transact business of any kind and that his mind & memory were so weak & impaired that he could not recognize his ordinary friends & acquaintances, and even in the smallest of concerns was obliged to have an interpreter -- Your Petitioners further expressly charge that the said will was made & written by the solicitations and under influence of his wife Judith Massey now Judith Shaw and her friends -- that he was carried seven or eight miles from home for the express purpose -- and that such was her influence over him that in the course of one or two months she had four or five wills written & signed and then destroyed to her whim or her interest suggested -- Your Petitioners further show unto your worship that your Petitioners John is an inhabitant of South Carolina and your Petitioner Samuel out of state, so that they had no knowledge of the probate of the said paper writing until very lately and therefore had not the means of contesting it -- Your Petitioners pray that a notice may ????? to Zachariah Shaw & Judith Shaw his wife, John Brasfield & George Brasfield Executors of the said Richard Massey to answer and that your Worship will decree a rehearing of the probate of the said paper writing & your Petitioners will ever pray State of North Carolina To the Sheriff of Wake County Greetings You are hereby commanded to summon John Brasfield & George Brasfield Executors of Richard Massey dec'd to appear before the Justices of the Court of Pleas and Quarter Sessions held for the County of Wake at the Court House in Raleigh on the third Monday of August next and there to answer the Petition of Jesse Olive & wife & others on the probate of the Will of said Richard Massey dec'd wherein Jesse Olive & wife & others are Petitioners & Zachariah Shaw & wife & others are defendants.
