All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Watson beverly_wat@msn.com July 11, 2010, 2:12 pm Written: January 5, 1869 Recorded: March 15, 1869 Wake County, North Carolina Deed Book 27, Pg 61 5 Jan 1869 Jarratt Broadwell & wife } This Indenture, made and entered into the 5th day To } of January A.D. 1869, between Jarratt and Seth Broadwell } Elizabeth Broadwell, of the first part and Seth Broadwell of the second part - all of the County of Wake and State of North Carolina: Witnesseth That Jarratt and Elizabeth Broadwell hath for and in consideration of the sum of Two hundred and fifty dollars, to us in hand paid by the said Seth Broadwell the receipt-whereof is hereby acknowledged hath given granted bargained and sold and by these presents doth give, grant, bargain and sell unto the said Seth Broadwell, a certain tract or parcel of land lying and being in the County of Wake and State aforesaid on the Waters of Furman Creek, adjoining the land of Rufus Upchurch, Mary Wimberly, and others, and bounded as follows, towit: Beginning at a small Black Gum in Rufus Upchurch’s line running West 117-1/2 poles to a Sweet Gum; thence North 117- 1/2 poles to a Hickory in Mary Wimberly’s line; thence East 117-1/2 poles to pointers; thence South 117-1/2 to the first station containing eighty-five acres more or less with all and every the appurtenance thereunto belonging or in any wise appertaining and we do hereby covenant to and with the said Seth Broadwell and his heirs, that we have before the execution of this deed, full right absolute and lawful authority to sell the said Land and premises, and agree hereby to warrant and forever defend the right and title of the same to him the said Seth Broadwell, his heirs and assigns for ever. Council Wake County } Be it remembered, That on the 12th day of March 1869 In the Probate Court } before the undersigned Judge of Probate for said County, personally came Jarratt Broadwell and Elizabeth Broadwell his wife, the persons described in and who signed the foregoing deed, and acknowledged the due execution thereof by them as their act and deed. And thereupon the said Elizabeth Broadwell being by the undersigned privately examined separate and apart-from her said husband touching her free consent in the execution thereof doth declare on such her examination that she had executed the same freely of her own free will and accord, and without any force, fear or undue influence of her said husband or any other person, and does still voluntarily assent-thereto. Therefore Let the said deed with this certificate be registered. J. N.
