To have and to hold, the aforesaid land and premises togethr with all priviliges thereunto or in any wise Belonging to him the said Thomas Mial his heirs and assigns forever. I the said Edward Hocut and Ellindar Hocut my wife for ourselves our Heirs and Executors do covenant and agree with the said Thomas Mial his heirs and assigns forever and I the said Edward Hocut and Ellender my wife shall and will warrant and defend, the right title and Interest, of aforesaid land unto the said Thomas Mial his heirs and assigns forever against all manner of claims of persons whatsoever, in witness whereof, we have hereunto set our hands and seals the date above written. In presence of us Johnson Britt and James (x - his mark) Sellers Signed Edward Hocut Ellender (+ her mark) Hocut Wake County, February Term, 1808 The written Deed from Edward Hocut and his wife Ellender Hocut to Thomas Mial was exhibited in Open Court probate and duly prove by the Oath of Johnson Britt and at the same time the said Ellendar Hocut being in Open Court, It is ordered the George Brasfield Esq. a Justice of the peace for the County aforesaid be appointed to take the private examination of the said Ellender, separate and apart from her said Husband, touching the said Deed, who reported that she executed the same freely without the coertion of her Husband.
