(Transcribed by Sloan Mason-SloMas7@aol.com) COURT RECORD South Carolina Fairfield District Personally appeared Margaret ROCHELL and Anderson ROCHELL before me and duly made oath that they have just cause to believe that Nathaniel ROCHELLE, Allen ROCHELLE, John ROCHELLE, Frances ROCHELL, now Frances LUCIOUS wife of Henry LUCIOUS; George ROCHELLE, Alithea ROCHELLE now Alithea BACKLEY wife of John BACKLEY, James ROCHELLE and Wiley ROCHELLE of whom James and Wiley have since died without issue to be the lawfull heirs of John ROCHELLE, dec'd and that he left no other child or children to the knowledge or belief of these deponents and that he departed this life about the year 1800. Inscribed in the Roll of Charleston at the rate of 480 dollars per annum to commence on the 4th day of March 1836. Certificate of pension issued 20th day of March 1854 and sent to Hon.P.S.BROOKS House of Representatives-Semi annual allowance ending 31 Aug.1841. South Carolina,Edgefield District On the 8th day of Nov.1853 before me,James BLACKWELL,magistrate for the district and state aforesaid,personally came John ROCHELLE a resident of the district and state aforesaid who being duly sworn,declares upon oath that he is the son and only living heir of Capt. John ROCHELLE dec'd. (now known) who was Capt. in the 9th Reg. of N.C.Cont.commanded by Col.John WILLIAMS in the War of the Am.Rev. and tht he makes this declaration for the purpose of obtaining the Pension certification certificates to which he may be entitled for any money or moneys,that may be found and are payable to me,is above stated sworn to and subscribed to me was written:Sign:John ROCHELLE, James BLACKWILL,Magistrate !Know all Men by These Presents:that I John ROCHELLE of the District of Edgefield and State of South Carolina,do by these present make,constitute and appoint A.PERRIN? of the district and state aforesaid my true and lawful attorney for me and in my name to ? and recieve of the Depart. fothe Justice of the U.S. the pension Cert. to which I may be entitled for the money that may be found are, and payable to me as the son and only surviving heir of Capt. Sign:John ROCHELLE James BLACKWELL,Mag. !South Carolina-Edgefield District On this day 8th Aug. 1853,before me James BLACKWELL, a Mag. for the district and state aforesaid personally came Frederic LUCIUS? age 89 years, a resident of the district and state aforesaid, who first being duly sworn according to law, doth on his oath declares that John ROCHELLE is the son and true representative of Capt. John ROCHELLE,dec'd. who was a Capt. in the 9th reg. of N.C. Cont.commanded by Col. John WILLIAMS in the War of the Am. Rev.,that this deponent became acquainted with Capt. John ROCHELE very soon after the war afforesaid and kept up an intimate acq. with the said Capt. ROCHELLE,dec'd until the day of his death which took place on or about the day of 16 May A.D.1802, that he well remembers that Capt. ROCHELLE aforesaid lived with his wife Patience ROCHELLE in Richland District in the aforesaid state of S.C.,for several years previously to his death, that Capt. ROCHELLE and Patience ROCHELLE his wife actually lived together as husband and wife up to the day of the death of the former, and were always so considered, that they had several children as such and ? within the personal knowledge of this reponent?to state that all of said children are now dead except John ROCHELLE the claimant in this case, and Allen ROCHELLE who moved o the sate of Tenn. about thirty years ago and has not been heard of for many years and it has also been reported and believed that he is also dead, and it may be the more ? believed from the fact that nothing has heard of one said Allen ROCHELLE for 30 years, and were from his advanced age,that after the death of Capt. J.ROCHELLE of ? his widow, Patience ROCHELLE, dec'd. lived for some time in Richland District aforesaid, and then moved to the district of Union in the state aforesaid, where she lived for sometime and then moved to the district of Spartainburg in the state aforesaid,where she died on or about the 31 day of Aug.A.D.1841, in the 85, year of her age,still being the widow of the aforesaid Capt. John ROCHELLE, and never having been married after the death of said Capt. J.ROCHELLE until the day of her death; and ? declares that he has no interest whatever in the result of this case of John ROCHELLE for the pension of his Father, and that the facts stated in this affidavit, ? come within the knowledge of this reponent from the facts that he knew Capt. J. ROCHELLE dec'd when very young and having lived near him and all his family ever since, except those of it who have moved from the state, and having personal knowledge of such facts ,as are state above. Sign:Frederic (X) LUCIUS James BLACKWELL !South Carolina-Richland district-22 Jan.1854 James BOSTWRIGHT personally appeared before James L.GUIGNARD,Judge of the court of Ordinary for the district aforesaid, Mr.BOSTWRIGHT being 80 years of age,a resident of district and state, and sworn according to law,declares upon oath that he know well Capt.John ROCHELLE dec'd who served as Captain in the 9th reg. of N.C.Continentals comm. by Col.John WILLIAMS in the war of the Rev.and that this deponent moved to and became a Resident of the said district of Richland S.C. in the year 1791,during which year he made the acqaintance of the said Capt. John ROCHELLE aforesaid,he the said Capt. ROCHELLE then being a citizen of Richland district of Richland in the state of S.C.that and well remembers that the said Capt. ROCHELLE then in the year 1791,aforesaid,lived with his wife Patience ROCHELLE, that the said John and the said Patience actually lived together as husband and wife and were so considered in the community.that the said John and Patience ROCHELLE in the said year 1791 had five children living,that the ? one of these children were now living, would be between seventy five years of age, that they were considered lawfully married.Capt. John ROCHELLE died about the year 1802,leaving his wife Patience ROCHELLE surviving him,that after his death she moved to Spartanburg or Union district where she died about 1841. Know all men by these present that one John ROCHELLE and John RICE both of the county and state aforsaid are held and firmly bound unto his excellency,Thos. BURKE,Esq. Governor and his successors in office in the sum of five hundred pounds current money of the state aforesaid to which payment will and duly to be made and done we bond ourselves and each of us over and each of our heirs and jointly and severally ,firmly by these presents sealed with our seal and dated this 8 day of Sept. Anno domini one thousand seven hundren and eighty one.The condition of the above obligation is such that whereas the above bounden John ROCHELL hath this day applied for and obtained a licence to be joined in the holy state of matrimony with Patience THOMAS ,now if therefore their be no lawful cause to obstruct the marriage for which the said license was obtained the above obligation to be void, also to be and remains in full price and virtue.
