Wake County, NC - Will & Estate Records File contributed for use in USGenWeb Archives by Melanie Atkins Elizabeth Atkins Will of 1803 Transcribed from copy received from NC State Archives In the name of God Amen, I Elizabeth Atkins of the County of Wake and State of North Carolina, being weak in Body but in perfect mind and memory, and calling to mind the mortality of my Body, knowing it is appointed for all to die, do make, and Ordain this my last Will, and Testament, in the following manner, ~Imprimis , I give and Bequeath unto my Son Ica Atkins, a Tract of Land (adjoining the Land, I now live on, and the Lands belonging to Moses Sugg, and Jesse Mitchell) containing Seventy Nine acres, more or less, it being a tract of Land, which was bequeathed to me, by my husband, recourse being had to his Will, will more fully appear, I give the Same, I say to my Son Ica Atkins, to him, and his Heirs forever, Item I give and bequeath to my Son Ica Atkins, my negroe man Moses to him and his Heirs forever, Item I give and bequeath to my Son Ica Atkins, one featherbed and furniture, all my chairs, one pine Table, one dutch oven, Two of my smallest iron pots, one pewter dish, Six pewter plates, Six pewter Spoons, Six Knives and forks, Twenty barrels of sound Corn, Two Blade Stacks, all my Tubs, pails, and Piggins, all my Plantation Tools, my ox Cart, and Gear, and one Ox, Four hundred weight of Bacon, Two Cows and Calves, (to be chosen by my Executors), my Bay Horse, called Button, and all my House hogs (to wit) four sows, and eighteen shoats to him and his Heirs forever, Item, I give unto my Sons Lewis Atkins and Ica Atkins (Jointly) all my Casks, and my Still, to them and their Heirs forever, Item I give unto my Son Lewis Atkins, Two Cows and Calves, (to be chosen by my Executors), one Bed and furniture, my largest Iron pot, and the remainder of my Pewter, (which I have not given to my son Ica Atkins) to him, and his Heirs forever, Item I give unto my Daughter Nansy Myatt, (wife of Briton Myatt) my dark bay Mare, called Pigeon, to her, and her heirs forever, Item, It is my Will and desire, that all the rest of my Estate be sold, and Seven Tenths of the money arising from the said sale be equally divided between my Seven following children, (to wit) - William Atkins, Nicholas Atkins, Sally Hutchins, (wife of William Hutchins), Isaac Atkins, Josiah Atkins, Lewis Atkins, and Polly Pearson, (wife of Simon Pearson) to them and their Heirs forever, ~ Item I lend to my son Hutchins Atkins, one Tenth part of the money arising from the sale of that part of my estate, which I have before directed to be sold, during his natural life, in case he dies without issue lawfully begotten, and should that be the case, it is my will and desire, that at his decease the same should be equally divided between the rest of my children to them and their heirs forever, but if he dies leaving Issue Lawfully begotten, then, and in that case, it is my desire that the same be equally divided amongst all his children, to them and their heirs forever, Item I lend to my daughter Betsy Mills, (Wife of John Mills) one Tenth part of the money arising from that part of my estate which I have before directed to be sold, but with this reserve, (to wit) to be put in the Hands of my son Lewis Atkins whom I do hereby appoint trustee for the same, and I do hereby direct him to apply such part, of the said money to my said Daughter Betsy's use, from time, to time as he shall think proper, till the whole be exhausted, and shoud there be any of said money left, in my said son Lewis Atkins hands, unappropriated, at the Death of my said daughter, Betsy, my Will and desire is that the same be equally divided , amongst my said daughter Betsy's children (if any) to them and their heirs forever, but if she dies leaving not any child, it is my desire that the same be equally Divided amongst all the rest of my children, to them and their heirs forever, Item, I lend unto my daughter Nancy Myatt (wife of Briton Myatt) one Tenth part of the money, arising from the sale of that part of my estate, which I have before directed to be sold (after deducting one hundred pounds, out of the said one tenth part) which one Tenth part after making the aforesaid deduction of one hundred pounds, it is my Will, and desire, should be put in the Hands of my son Lewis Atkins, whom I appoint Trustee, and do hereby direct him, to apply such part of said money to my said daughter Nansy's use, from time to time, as he shall think proper, till the whole be exhausted, and if any of said money remain in the hands of my said son Lewis Atkins, at the death of my said daughter Nansy, it is my desire, that the same be equally Divided, between all her children to them and their Heirs forever, Item it is my desire that the one hundred pounds, which I have before directed shoud be deducted out of Daughter Nansy's tenth part, shoud be equally divided between my Seven following children (to wit) William Atkins, Nicholas Atkins, Sally Hutchins wife of (William Hutchins) Isaac Atkins, Josiah Atkins, Lewis Atkins, and Polly Pearson, (wife of Simon Pearson) to them and their heirs forever, Item it is my Will and desire that all my just debts, be paid out of the money, which I may leave at my death and the remainder of my money (if any) and also all the money which may be owing to me at my death, it is my desire that the same be equally divided between my Ten following children, (to wit) William Atkins, Nicholas Atkins, Sally Hutchins (wife of William Hutchins) Isaac Atkins, Josiah Atkins, Lewis Atkins, Hutchens Atkins, Betsy Mills (wife of John Mills), Polly Pearson (wife of Simon Pearson) and Nansy Myatt (wife of Briton Myatt) but with this reserve that the part of my said money, and debts due me, at my Death which will be coming to Hutchins Atkins, Betsy Mills, (wife of John Mills) and Nansy Myatt, (wife of Briton Myatt) be exactly upon the same plan and footing, with the money lent them in the preceding part of this my Will,~ Item it is my Will and desire, that all the money which my son Lewis Atkins may receive as Trustee, for my Daughter's Betsy Mills and Nansy Myatt, shoud be put out to Interest, and the interest to be applied exactly in the same manner as I have directed that the Principal shoud be, Item I do appoint my sons, William Atkins, Nicholas Atkins, and Lewis Atkins executors of this my last Will and Testament, disannulling and revoking, all others made heretofore by me, in testimony whereof I have herewith affixed my hand, and Seal this 26th day of February, one thousand eight hundred and three.- Signed, Sealed and declared, ???
