I William Barbee of the State and countey aforesaid being of sound mind and desposing memory yet considering the uncertainty of life and the certainty of death do make and declare this my last will and testament in manner and form as follows (to wit) Item 1st I give my bodey to its mother dust and my Spirit to god who gave it me - Item 2nd my will and desire is that my bodey be neatley buried and my furneal expenses be paid by my executor hearinafter named - Item 3rd my Will and desire is that all of my just debits be paid out of my estate and I hereby appoint my two sons Rufus and Madison Barbee Executer to all intents and purposes - Item 4th I hereby give and bequeath to the bodely heirs of my daughter Margaret Williams deceased fifty one and half acres of land in the south west corner of my land adjoining the land I gave her known as the Ford land, to equal with Rufus and Madison in land - Item 5th I hereby give and bequeath to my my grandson John Rufus Williams fifty dollars that I intended giving to his Ma - Item 6th I hereby give and bequeath to my daughter Viola Victoria Barbee and her bodely heirs one hundred and thirty acres of land on the east side of my land adjoining Madison Barbee, Joseph Mainard and Laney Sears & Edy Mainard fifty acres of this land is to be on the south side of the road adjoining Madison and Joseph Mainard The baance of the north side of the Road Also fifty dollars, one bed and sted and furniture, one cow and calf, one sow and pigs, 3 chairs - one side board - one that I have on hand Item 7th I hereby give and bequeath to my beloved wife A.C. Barbee the ballance of my estate perarsonal real and perishable,to have and to holdas her own, with the exception of the land, and at her death the land is to come back to my lawful heirs and equaely devided batwn all of thm - This property is for her to dispaose of as she may see propper - in testimony whereas I have st my hand and seal this 1 March 1882 - William Barbee Witness W. L Herndon Codicil to my former will - Whereas, I William Barbee have made my last willl and testament in writing bearing date of 1 March 1882, and have therein made sundry divsis and bequeaths, according to the then circumstances of my estate, but circumstances having now materially changed I do hereby declare this to be a codicil to my said Will to be taken and construed as a part thereof. Item 1st My Will and desire is that my beloved Grandson John Rufus Williams have 51 1/2 acres of land that I bequeathed to all my daughter Margaret Williams children in my will. Also for said John Rufus Williams to come in as equal heir with the rest of my children. In testimony of which I have hereunto set my hand and seal this the 20th day of February A.D. 1893 William Barbee attesto A. Theo Cotten W. G. Sears Wake County:- In the Superior Court In The Matter of the Will of William Barbee Deceased Rufus Barbee & Madison Barbee being sworn, doth say: That William Barbee, late of the County is dead, having first made and published his last Will and Testament; and that Rufus Barbee & Madison Barbee are the executors named therein. Further that the property of the said William Barbee consisting of Real and Personal Property is worth about $4,500, so far as can be ascertained at the date of this application; that Rufus Barbee Madison Barbee Viola V. Young & The Children of Margaret Williams deceased & Jno R Williams are the parties entitled under said will to the said property. Sworn to and subscribed before me this First day of October 1895 D.
