I, J.W. Cope of the aforesaid county and State, being of sound mind, but considering the uncertainty of my earthly existence, do make and declare this my last will and testatment. First. My executor, hereinafter named, shall give my body a decent burial, suitable to the wishes of my friends and relatives, and pay all funeral expenses, together with all my just debts, out of the first moneys which may come into his hands belonging to my estate. Second. I give and devise to my brother Hilliard Lawrence Cope two thirds of all my land, situated in Houses Creek township of County and State above named adjoining the lands of J.S. Hailey and others containing 87 acres more or less. Third. I give and devise to my sister Flonnie May Cope one third of all my land situated in Houses Creek township of County and State above named adjoining the lands of J.S. Hailey and others containing 87 acres more or less. Fourth. The divisions marked Second and Third are subject to the following conditions: vis That both Hilliard Lawrence and Flonnie May Cope shall each live to be twenty one years old and provided further that if either one should die before he or she is twenty one years old, then all of my said land I give to the one then living. Fifth. It is my will and desire that all moneys accruing from the rent of any lands after my death shall be deposited in a Savings bank at interest and there remain untill Hilliard Lawrence and Flonnie May Cope are twenty one years old and then to be eaqually divided and given to the said Hilliard Lawrence and Flonnie May Cope and provided that if either Hilliard Lawrence or Flonnie May Cope shall die before he or she is twenty one years old then the one living shall be given all moneys acrruing from the above mentioned rents. Sixth. I give and devise to my father Calvin E. Cope all moneys that I may have at the time my death except what is necessary under the devise marked first of this will. Seventh. I hereby constitute and appoint my trusty friend M.J. Carlton my lawful executor to all intents and purposes, to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof - hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof, I, J.W. Cope, do hereunto Set my hand and seal this the 23rd day of December 1909. J.W. Cope, seal Signed and delivered in the presence of: G.M. Jackson, witness M.J. Carlton, witness North Carolina, Wake County I, J.W. Cope of said County and State make this codicil to my last will and testament published by me, and dated the 23rd day of December 1909, which I ratify and confirm, except to add to the item marked fourth and beginning at the end of said item as follows. That should Hilliard Lawrence Cope and Flonnie May Cope both died without issue then all my land mentioned in said will I give and devise to the three children of my deceased brother Lonnie Cope to have and to hold jointly and equally. Second. And at the end of item marked fifth to add the following: And should Hilliard Lawrence Cope and Flonnie May Cope both die before they are twenty one years old, then I give and devise to the three children of my deceased brother Lonnie Cope all the said moneys accruing from the rents of said land to be divided eaqually among them. In testimony whereof I the said J.W. Cope do hereunto set my hand and seal this the 26th day of March 1910. J.W. Cope, seal Signed sealed and published by the said J.W. Cope] passed away 3 Apr 1910 and is buried at the Poole-Cope Family Cemetery located at the corner of Ray Road and Ashtonshire Court in Wake County. Several members of this Cope family passed away of TB and are buried in the same cemetery. James Willie Cope was the son of Indianna Poole & Calvin Edward Cope.
