Wake County, NC - WILLS - John Fort, 1825 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Wake County, NC, Wills 1771-1966 North Carolina Archives In the name of God Amen, I John Fort of the County of Wake & state of North Carolina being of sound and perfect mind and memory be God 27th of August 1824 make and publish this my last will and Testament in manner following viz Item 1 I lind unto my beloved Wife Frankey Fort all my land, Also all My negroes (ie) Terey Peter Charles Beck Surry Julia Clary & Ivey and also all the balance of my property of every description during her natural life and widowhood, but in case my Wife & my Executor hereafter to be appointed think proper (provided my wife Franky is single) may lend or pay over any of the legacies hereafter to be given at any time. Item 2 I give to my Grand Daughter Mary Fort Two Hundred dollars. Item 3 I give to my Grand Daughter Charlottia Read One Hundred dollars. Item 4 I give and bequeath to Nancy Embrey daughter of Joel Embrey Three Hundred dollars. Item 5 I give unto six of my greatgrand children (ie) Christopher C. Moring, Mary A. E. Moring, James S. Moring, Lucy M. Haley, Richard H. Haley, and Susan Haley Fifty dollars each. Item 6 I give to my son James Fort One Negro Man Peter and Three Hundred & sixty two & One half dollars Now I want I to be understood that teh Money above mentioned is at this time in the hands of my son James Fort and the agreement between us is that he shall buy another Negro with said Money and bring it to my house and remain ther for my use as all the property above Mentioned. Then my will and desire is that my said son Jas Fort have said Negro. Item 7 I give to my grand son John C. Fort the land where I now live on the East side of Nuse River. One Negro Man named Ferry and my still. Item 8 I give to my grand son James C. Fort my lands on the West side of the Nuse River. Now my will and desire is that if with or both of my grandsons John C. Fort or James W. Fort should die leaving no lawful heirs that the land which I have given them shall be equally divided among the following persons (ie) Jas Fort and the living children of John Fort Item 9 At the death of my wife (or widowhood) I wish the residue of my property to be sold and the money arising from said sale and all the balance of my Estate of every description after paying the legaces here to for given & paying my last debts, I give One half to my son James Fort and the other half to my grand children (ie) Nancy Smith, Zelpha Smith, James W. Fort, John Caswell Fort, and Martha E Fort. I wish this will to be understood that all the legaces given I give to them and their heirs forever and the gifts not to take place during the natural life or widowhood of my Wife, without she and my Executor think proper And lastly I do hereby appoint son James Fort Executor to this my last Will & Testament set my hand & seal this day and date above writen Signed sealed and acknowledged In presence of Almond Bevey (---) John Fort (seal) her Suranzo X A.
