Wake County, NC - Will of Warren Hobbs, 1864 ~~~~~~~~~~ State of North Carolina Wake county William Warren Hobbs 1 September 1864 In the name of God Amen! I William W. Hobbs, of the county Wake, and the state of NC being of sound mind and disposing memory do make, publish and declare, this my last will and testament in ---- and form following: to viz.: First: I give and bequeath unto my beloved wife Foetna Hobbs, for and during her natural life. All of my estate, both real and personal that I may possess and be entitled to, at the time of my death. Second: If after my death, my said wife should marry and have a child or children, it is my will, and I so give and bequeath to such child, or children, had by my wife aforesaid, all my estate and property both real and personal, to be possessed and enjoyed by them after the death of their mother, and not before. Third: Should my said wife, have neither child nor children, it is my will and I so give, devise and bequeath, all the estate and property both real and personal which I may have at the time of my death, to my wife absolutely to be disposed of during her life as one may think fit and to such persons, after her death as she may will, properly executed, give and bequeath the same. Fourth: I nominate and appoint my friend and neighbor Rufus A. Dunn, to be executor, of this my last will and testament. And I authorize and approve him, if I should not have enough owing to me at the time of my death, to pay all my just debts and the necessary expenses of carrying out this will, to sell such of the property and estate above given to my said wife, as she may elect to have disposed of for that purpose. And I do by this writing, revoke, and declare void and of no effect all and any will and testament by me here to fore at any time made. In testimony where of, I have here unto set my hand and affixed my seal, this the 1st day of September, AD 1864. Norwood Stuart Busbee [William Warren Hobbs (b. 1805) owned 2200 acres of land in Marks Creek in 1850. He lived on and around where Clydes Chapel now stands in Eagle Rock, NC. His mother Chloe Lassiter Hobbs lived on the plantation until her death (after 1850) as well as William's sibling's Kessiah (b. 1810) and Samuel (b. 1801) His sister Delicate and her husband, Bryant Strickland, lived next door to them. William never had any children of his own. He inherited his father's (William B. Hobbs) plantation in 1839 when he died. His plantation ended up with his nephew James William Henderson Hobbs and Schezaid D.
