Wake County December Sessions 1798 The within last Will and Testament was duly proved in open Court by the Oaths of Nathaniel Jones Esq.(WP) William Speight and Burwell Sims Subscribing Witnesses thereunto, and ordered to be Recorded ____________________________ Nath. Lane C.C. Recorded in the Clerks Office in the County of Wake in Book E and page (249) the first day of February 1799 Nath. Lane C.C. State N. Carolina Wake County In the name of God Amen. I Joseph Lane Senior being sick and weak in body, but of sound mind and Memory, and knowing that it is appointed for all men to die, do make and ordain this my last Will and Testament, in manner and from following (viz) First I give and Bequeath to my Grand son Joseph Lane (being an Infant at present) the Land and Improvements whereon I now dwell, and all the Lands belonging to me adjoining. containing by Estimation, one thousand Seven Hundred & fifty two, acres, to him his Heirs and assigns For ever._________ Also I further give and Bequeath to my said Grand son Joseph Lane, one Negro Boy Names Relph, to him his Heirs & assigns For ever._____ and in case my Grand son Joseph Lane Shall die without an Heir, Lawfully begotten, my Will is that my son Joseph Lane Heir the said one Thousand Seven Hundred & fifty two acres of Land, together with all the Improvements there unto belonging, to him his Heirs and assigns For ever ____________ and also the said Negro Boy Relph, to him his Heirs & assigns For ever. And it is further my Will that my son Joseph Lane, have the use of the Estate of my Grand son Joseph Lane, during his Minority_______________ Turn over Also I give and Bequeath to my son Joseph Lane, one Negro man Named Ned, & One Negro woman Named Sue, to him his Heirs and assigns For ever. ___________________ Also I give and Bequeath to my Daughter Sarah McCullers, on Negro man Named Hercolies, one Bed and Furniture, and Five Cows & calves, to her, her Heirs and assigns For ever. _________________ Also I give and Bequeath unto my Grand son Henry Augustine McCullers, one Negro man Nam.d Davie to him his Heirs and assigns For ever. ____ And my Will is that my Executor here after Nam.d pay all my Just debts out of that part of my estate Not already Legacy.d in this my last will & Testament, and the Remainder part of my estate after my Just debts are discharged, if any remainder, I give to my son Joseph Lane. ______ Like wise I do hereby constitute and appoint my son Joseph Lane Executor [sic] of this my last will and Testament _______________ Revoking all other Wills & Testaments of what nature or sort Heretofore made, Ratifying this & no other to contain my Last Will and Testament, Witness whereof I have hereunto set my hand, & affixed my seal the 6th day of March AD1798 Signed Sealed Published Pronounced and Declarred by the s.d Jos.
