Wake County, NC - Will of Benjamin Revils, 1835 ~~~~~~~~~~~~~~~~~~~~~~~~~~~ Any word which is followed by a question mark, I failed to decipher. The Will is recorded exactly as I read it except for a few commas or periods for clarity. The writer of the Will used an "e" in the place of an "a" in several places. If a word doesn't seem to make sense, replace the "e" with an "a" & you will then understand it. I wanted to keep the words 'as written' & that's why I didn't correct them. Cynthia Bowermaster Eppers 31 Aug 2003 State of North Carolina City of Raleigh I Benjamin Revils do hereby make publish and declare the following to be my last Will and Testament First I desire that my Executor may sell all my property of all kinds except my my wife / who is my slave / and with the money arising from such sales he shall pay all my just debts. and then he shell apply so much of said money as may be requisite & necessary for procuring the emancipation of my slave Delia according to the laws of the state & for her removal out of the state - and the residue of said money he shell pay over to Delia (begin underline) after she is set free (end underline) and he is requested to proceed in the sale & emancipation without delay. Item second. It is my express will that my wife who is my slave Delia shall be set free by my Executor or by whomsoever qualifies to execute this Will, and for that purpose I bequeath the right of said Delia to my Executor in trust & confidence that he will without delay take all lawful ways & meens to have her liberated, & in doing this I hereby cherge my whole Estete with the cost & expense thereof - And if there should be any informality in this will (inserted) or other thing (end insert) so as to prevent the one execution of this trust it is my wish that the said negro Delia be removed out of the State forthwith to a non-slave-holding State at the expense of my Estate and the Executor is hereby discherged from all liability to account for her value or the amount of said Expenses unto my next of kin or any other person whomsoever. Third I do hereby nominate & appoint my trusty friend Allen Jones / Blacksmith / sole Executing of this my last will and request him to execute the same. Hereby intending that he as Executor shell hold the proceeds of my Estate in his hends until my wife Delia is liberated & set free & that after that he shall pay to her all that is left in his hands belonging to my Estate. Fourth. Should my Executor herein nemed die before he has executed this Will I desire that all the powers & authority vested in him by this will be construed to extend unto him who may be appointed to administer on my Estete, and that my anxious wishes may not be disappointed. I hereby entreat on my dying bed that W. Cherles Menly & W.H. Haywood Sr. / who have been kind to me while I am alive / will see that no advantage is taken of my wife. And it is my Will further that if Allen Jones dies as aforesaid, either of these gentlemen may select an Admr & whatever they, or either of them, agree that the Admr shell be paid, for Executing my Will, he is to receive.
