Wake County, NC - James William Rowland Will and Codicil ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Will of J.W. Rowland Last Will and Testament of J.W. Rowland North Carolina, Wake Co. I, J.W. Rowland, of the State and County aforesaid, being of sound mind and memory, do hereby make, declare and publish this my Last Will and Testament, hereby revoking any and all other wills I may have heretofore made. Item No. 1. I have already disposed of all my lands and Real Property except fifteen acres around Willow Springs station, adjoining the lands of Furman Dowd, Joe Murray, John Rowland and Cleveland Rowland; and this said fifteen acres of land mentioned aforesaid I give, devise and bequeath to my following named children in equal shares: ALTON A. ROWLAND, ALIE E. PARRISH, J. CARL ROWLAND, and MARY MAY FISH. If my said children above mentioned should prefer, the said land above mentioned may be sold as a whol and the proceeds thereof equally divided as aforesaid. Item No. 2. All my personal property at my death, shall be sold for cash and after paying all my just and honest debts, the remainder shall be divided as follows: To my daughter, MARY MAY FISH, I give and bequeath the sum of Five Hundred dollars in cash. To my daughter, ALIE E. PARRISH, I give and bequeath the sum of three hundred dollars in cash. The residue of all my personal property sold as above directed shall be divided equally and share and share alike among all my children named in Item No. 1, hereof above. Item No. 3. I hereby nominate, appoint and elect my son, ALTON A. ROWLAND, to be executor to this my last will and testament; who shall not be required by the court to give bond. In the event the said ALTON A. ROWLAND should become incapacitated to act as my executor; I hereby appoint my other son, J. CARL ROWLAND to succeed him and to act in his stead. Rowland, of said County and State make this Codicil to my Last Will and Testament, published by me, and dated the 12th day of January 1922, which I ratify and confirm, except as the same shall be changed hereby. No. 1. Whereas by my Will above mentioned and otherwise, I have given and devised unto my son J. CARL ROWLAND more real estate than any of my other children; he shall not charge my estate with any bill for board or personal care of me, until I shall becomre helpless and unable to wait on myself. No. 2. J. CARL ROWLAND and ALTON A. ROWLAND, my sons, shall pay to my estate at the time my estate shall be settled, all notes and obligations due it, with interest thereon; and in no case shall the Statute of Limitations be pleaded as to any item due my said estate. Rowland decease is exhibited before me the undersigned, Clerk of the Superior Court for said County by A.A. ROWLAND the executor therein mention and the due execution thereof by the said J. W. ROWLAND is proved by the oath and examination of J.W. Blalock and J.S. Fulghum, the subscribing witness thereto, who being duly sworn doth depose and say, and each for himself, deposeth and saith that he is a subscribing witness to the paper writing now shown him, purportin to be a Codicil to the last will and testament of J.W. Rowland; that the said J.W. Rowland, in the presnece of this deponent, subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date of the 2nd day of January 1926. And this Deponent further saith, that the said J.W. Rowland the testator aforesaid did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be a Codicil to his last will and testament, and this deponent did thereupon subscribe his name at the end of said Codicil as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith that at the same time when the said testator subscribed his name to the said Codicil as aforesaid, and the time of the deponents subscribing his name as attesting witness thereto, as aforesaid, the said J.W. Rowland was of sound mind and memory, of full age to execute a will, and was not under any restraint, to the knowledge, information or belief of this deponents: And further these deponents say not. Severally sworn and subscribed this 28th day of January 1929 before me. E. Lloyd Tilley, Assistant Clerk Superior Court. J.W. Blalock, J.S. Fulghum North Carolina, Wake Co. In the Superior Court. It is therefore Considered and Adjudged by the Court that the said paper writing and every part thereof is the Codicil to the last will and testament of J.W. Rowland deceased.
