I Whitmell Alston, of the county & state aforesaid being of sound & perfect mind and memory, do this twenty second day of February one thousand eight hundred & twenty four make and ordain this my last will & Testament, revoking all others. Item I give and bequeath to Whitmell H. Alston Kearny the following Negroes, by name (viz) Frank, Peter, Mason, Clocy, Harriot & William. Also I give and bequeath to Whitmell H. Alston Kearny, all the Land that I own with all my House hold & kitchen Furniture & four wheel carrage, the Land I wish his farther to dispose of should he think it adviseable, & the proceeds to go to said Whitmell H. Alston Kearny, and should he die before he maries or comes of age, I wish all the above named property to go to his mother, B. H. J. M. A. Kearny. Item give to my Brother Samuel Alston two Negroes (viz) by name Jacob & Anderson. Item I give & bequeath to Polly H. Alston Daughter of my Brother Philip two hundred dollars. Item I give and bequeath to my Brother Thomas Alston my bay horse & gun. Item I give and bequeath to Carolina Cornelia Kearny my gold watch. I [wish ?] after paying all my just debts the ballance of my property of every decription not given a way I wish to be devided in four equal parts and that the Heirs of my Brother Philip Alston to be entitled to one fourth my Brother Samuel Alston one forth, my Sister Martha Hawkins one fourth, & my Sister B. H. J. M. A. Kearny one fourth part, In witness where of I have hereunto set my hand and affixd my seal this 22 Feb one thousand eight hundred & twenty four Whitmell Alston {seal} Signd in presence of Miles Bobbitt (Jurat) Susanna Bobbitt (Jurat) State of No Carolina Warren County -- May Court 1824. This last will & Testament of Whitmell Alston was exhibited in open court for probate and the execution thereof being proved by the Oaths of Miles Bobbitt & Susanna Bobbitt subscribing witness thereto, on motion it is Ordered to be recorded. whereupon Wm K Kearney qualified as Administrator with the will annexed.
