Warren County, NC - Will of Lewis S. Duke, 1864 ~~~~~~~~~~~~~~~~~~~ Warren County North Carolina Will Book 50 August Court 1864-The Will of Lewis S. Duke. I, Lewis S. Duke, of the County of Warren and state of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthly existence do make and ordain this my last will and testament in manner and form following. I give and devise to my beloved wife the tract of land where on I now live adjoining the lands of Stephen H. Turner and Nancy Mabry and others-containing ninety acres of land more or less-with all the improvements and appurtenances thereunto belonging, all the stock of hogs, horses, cattle, and sheep, with all the household and kitchen furniture. My Negroes, I give unto my beloved wife until my oldest son Green J. Duke arrives at the age of twenty-one years - then to be equally divided between my beloved wife and my children share and share alike. And lastly, I do hereby constitute my beloved wife my lawful executrix to all interests and purposes, to execute my last will and testament according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring all other wills and testaments hereby void made by me theretofore. In witness, whereof I, the said Lewis S. Duke do hereunto set my hand and seal this the 26th day of February A.D. 1863. Lewis S. Duke (seal) Signed and declared by the said Lewis S. Duke, to be his last will and testament in presence of John G. Bullock and John H. Bullock Warren County Court August Term 1864 The foregoing paper writing purporting to be the last will and testament of Lewis S. Duke, dec. is exhibited for probate in open court by Pheobe Duke, his wife, the executrix therein named and the due execution thereof by the said Lewis S. Duke, is proved by the oath and examination of John H. Bullock one of the subscribing witnesses thereto. It is therefore considered that the said paper writing is the last will and testament of the said Lewis S. Duke and the same is ordered to be recorded and filed. And thereupon the said Pheobe Duke qualifies as executrix by taking the oath required by law. Test. William A.
