Davis late sheriff of Washington County, State of No Carolina of the one part & Joshua B. Davenport, Edward T. Jarvis & wife Penelope, William Davenport and Ann Eunice Davenport Heirs of Alexander H. Davenport of the county of Washington on the other part, witnesseth that whereas by virtue of a certain writ of execution, issued from the May term 1838 of the Pleas & Quarter Sessions of said court of Washington County, at the instance of Alexander H. Davenport -- directed to the sheriff of Washington County, against the land of Enoch Spruill, -- on the 3rd Monday in August 1838, in this year of our Lord 1838 to the County Court. And whereas I the said Robert B. Davis late sheriff as aforesaid, did, by virtue thereof enter upon & levy the aforesaid writ of execution upon the following tracts of land, viz: Two tracts of land, one piece in the body adjoining of Ebenezer Pettigrew & Anson A. Spruill & others, and the other tract whereon Enoch Spruill last lived, adjoining of Ebenezer Pettigrew & James Newbury & others, say said Enochıs undivided part of it which by the death of said Enoch has descended to & become the property of his heirs at law, the property of said Spruills heirs for the want of goods & chattels, and did duly advertise & expose the same at public sale before the court house door to the highest bidder, to satisfy & pay the aforesaid writ of execution on the 20th day of August 1838, when & where Alexander H. Davenport appeared & bid for the said tracts of land the sum of ten 1/100 dollars and that being the highest & last bid, became the purchaser thereof. Now this indenture further witnesseth that for and in consideration of the aforesaid sum of Ten 1/100 dollars to me the said Robert B. Davis late sheriff as aforesaid by the said Davenport paid in satisfaction for this said purchase of land. I the said Robert B. Davis late sheriff as aforesaid by virtue of the act of assembly in such cases made & provided, hereby --, sell & convey unto the said Davenports, Jarvis & wife Penelope & their heirs & assigns the aforesaid tract of land situated in the county of Washington to have and to hold the aforesaid tracts of land with the improvements thereon, to the only proper use and -- of them the said Joshua B, William & Ann Eunice Davenport & E. T. Jarvis & wife Penelope, heirs of A. H. Davenport & their heirs & assigns forever, and I the said Robert B. Davis late sheriff of aforesaid do hereby for myself, my heirs, exrs & assigns forever warrant & defend all the said Enoch Spruillıs right & title & interest in the said tracts of land unto the said Davenports, Jarvis & wife Penelope & their heirs & assigns against the lawful claims or demands of all persons whomsoever, so far forth as I am bound by law as sheriff of the county of Washington but no further, be witness whereof I the said Robert B. Davis late sheriff as aforesaid have hereunto set my hand & affix my seal this day & date first above written sealed & delivered in the presence of J. J.
