Court Deed, 2 tracts of Land 90-¢ due Reg {illegible] to Clk State of North Carolina Washington County This Indenture entered ?? this the firs day of May Eighteen hundred & fifty seven, by deed between George W. Spruill & George Swain & wife Nancey Ann Swain of the first part and Ebenezer Dunston of the second part all of the County and State afforsaid Witnesseth that the parties of the first part being the sole owners of two tracts of Land, formerly owned by the heirs of Aaron Spruill decd said parties of the firs part being the purchasers of the heirs of Aaron Spruill decd and heirs ?themselves in the afforsaid ?Appeled Estate, and forther more witnesseth that the party of the first part being lawful heirs of the afforsaid Aaron Spruill dec both by heirship and purchases and the parties of the first part for and in consideration of the sum of Fourteen Hundred Dollars to the parties of the first part in hand paid by the party of the second part-the recpt in full is hereby acknowledged and the parties of the first part hath by these presents Bargained sold and confirmed and conveyed unto the party of the second part-and do herein and hereby bargain and sell and deliver unto said party of the second part his heirs and assigns, forever, two certain pieces or parcels of Land afforsaid situate and being in the County of Washington and State of North Carolina near the west side of Scuppernong River and Bounded more correctly and particularly as follows as By Refference to a Pattent dated twenty second of Augt in the year Seventeen Hundred & Eighty Six granted to Steven Spruill and Robert Davis ?num 416 and confirmed by deeds to Zephaniah Davis and conveyed by said Zephaniah Davis by deed to Caleb Collins for Thomas Collins and William Collins and confirmed by deed from Thomas and William Collins and from their heirs unto Aaron Spruill Decd and formerly known as Davis ?Junior Grant in Collins tract of land containing one hundred & fourteen acres by the same more or less seccondly one other tract known as a part of the ?? one in the Division of Lands of the heirs of Zephaniah Davis and to Robert B. Davis and from Robert B. Davis to Aaron Spruill Beginning in a poplar in Henrietta Swain's line runing thence northerly along a line of marked trees to the back line of the pattent thence westerly fifty-two and three fourths Poles to said lands above Described thence along the lines of said Collins deed herefore named to two pines the corner of Joshua B Davenport Eveline Davis and others thence easterly fifty two poles to the first station containing fifty four acres be the same more or less to have and to hold the afforsaid tracts of Land to the said Ebenezer Dunston his heirs and assigns forever- And the said parties of the first part doe herein and hereby bind themselves that a good title in fee simple pass by this deed and that the said parties of the first part doth herein and hereby forever warrant and defend the title herein and hereby conveyed from themselves their heirs and assigns and against the clauses or claims of any and all persons either in law or equity-?? the party of the second part his heirs and assigns forever ?? in witness whereoff the parties of the first part hath thereon set their hand and seal Signed sealed and delivered in presence of Samuel W Davenport X Test Joshua B Davenport G. Spruill [seal] George Swain [seal] Nancey Ann Swain x her mark [seal] State of North Carolina Washington County May Term 1857 Here is the due execution of the written Deed for Land from George W Spruill & George Swain & wife Nancey Ann to Ebenezer Dunston proved in open court by the oath of Samuel M Davenport the subscribing witness; and it being represented to the Court that the said Nancy Ann wife of the said George Swain is a feme covert; It is ordered by the Court, that Jno H Hampton Esqr J.P. (one of the memebrs of this Court now presiding) be appointed to take the private examination of the said Nancey Ann Swain separate & apart from her said Husband George Swain & within the ?? of this Court, touching her executing the said Deed freely & of her own accord, who reports to the said Court he made said private examination that the said Nancey Ann Swain declared that she executed the same freely & of her own free will to & accord without fear or constraint of her said Husband and that she doth now assent thereunto-Ordered that the said Deed with the probate & examination be registered Attest F.
