A search of available wills, estates and slave names does not confirm a relation to him. He married Mary (Polly) Carraway before 1816. She was the daughter of John Carraway whose wife's 1823 Petition for Dower states John Carraway died in September last, intestate, leaving his widow and Richard, Henry, John, Charles, Bryan, Betsey, Sally Carraway, Polly the wife of John McKinne, William, Zylpha, Ann, Charlotte and Jesse Carraway his children as heirs at law. The children of John and Mary McKinne were mentioned in her 1839 petition for dower and the 1850 census provides their ages: Bryant (not included in 1842 division of his father's land) Hepsey born 1816 married Wilbert J. Your petitioner further represents that said John McKinne left children and heirs at law the following persons Bryant McKinne and Hepsy McKinne who are of lawful age and Mary, Robert, Sarah and David McKinne who are infants under the age of 21 years and who have no guardian. Your petitioner further shews that her said husband died seized and possessed of a certain tract of land in said county containing about 300 acres adjoining the lands of George Collier, William Carraway and Junius G. Slocumb which descended to his said heirs at law subject to your petitioners right of dower. Your petitioner prays of your worships to issue a writ of Dower directed to the Sheriff of said county commanding him to summon a jury of good and lawful men to proceed to the premises to allot and lay off her dower by metes and bounds according to law and such other and further relief grant as your petitioner may of rights and in law ask and as in duty bound she will ever pray &c. The Petition of Mary McKinne respectfully sheweth unto your worships, that her husband John McKinne departed this life during the month of [blank] last leaving her as his widow and entitled as such to a year's allowance out of the crop stock and provisions of her said husband. Your petitioner further sheweth unto your worships that John Everitt of the county aforesaid has taken out letters of administration upon the goods and chattels rights and credits of her husband. Your petitioner therefore prays your worships that John Slocumb, John West and Bright Best may be appointed to lay off and allot to her years allowance out of the estate of her husband and report to the next term of the court and your petitioner as in duty bound will ever pray. Wright Atty Pro Petitioner ---- John McKinne Estate Sale, 1839 North Carolina, US, Wills and Probate Records, 1665-1998 Notice - The subscriber having qualified as administrator on the Estate of John McKinne dec'd will sell at six months credit all the perishable property consisting of horses, hogs, cattle, corn and fodder, house hold and kitchen furniture, utensils and other articles too tedious to mention on the 20 day of December next at the residence of said deceased. The subscriber having qualified and taken letters of administration on the estate of John McKinne dec'd hereby gives notice to all persons having demands against the said estate to present them for payment within the time required by law otherwise this notice will be plead in leu of recovery. Account of Sales of the property of John McKinne Dec'd sold the 20th of December 1839 at six months credit by John Everett Adm. Recorded Feb'y Court 1840. Buyers were the Widow, James Herring, William Thompson, William McKinne, William Carraway, Richard Casey, Hepsey McKinne, Bryan McKinne, R. W. Best, Elizabeth Hopton, Richard Langston and David B. Everett. ---- John McKinne Division of Lands - December 17, 1842 (Total acres 427.25 acres) Commissioners G. W. Collier, Bright Best and Wm. D. Cobb were directed by the Court of Pleas and Quarter Sessions at November Term 1842 to divide the land of John McKinne among the lawful heirs of John McKinne and on 17 Dec 1842 presented their findings to the court. Lot No 1 - drawn by Robert McKinne beginning at a maple on the run of Carraway's Creek in George W. Collier's line and on the south side of the Cypress Pond to a stake on the north side of Poplar Branch at the west end of the Mill Dam to the run of Carraway's Creek about 60 yards above the Mill house and containing 72 3/4 acres valued at $250. Lot No 2 - drawn by Hepsey Feutrel beginning at a stake at the west end of the Mill Dam and runs with Robert McKinne's line to a stake on the north side of Poplar Branch his corner in the back line to the run of Carraway's Creek in the Mill pond to a stake about 60 yards above the Mill house then north to the Mill dam and containing 72 3/4 acres valued at $200. Lot No 3 - drawn by Sarah McKinne on the run of Carraway's Creek in the Mill pond Hepsey's corner to the back line her other corner to a pine near the head of Short Branch to a pine on the north side of sd branch near Wm Carraway's Spring the old Stooping pine corner to the run of Carraway's Creek and containing 72 3/4 acres valued at $200. Lot No 4 - drawn by David McKinne beginning at a red oak George W. Collier's and James Slocumb's corner on the north east side of the marsh to a stake in the old road to George Collier's line at his cotton patch new Ground to a maple his corner near his ditch and containing 93 acres valued at $375. Lot No 5 - allotted to Mary McKinne beginning at a red oak David McKinne's beginning tree south to the old road David's corner with the south end of said road to two post oaks George W. Collier's and Mary McKinne's corner and containing 116 acres and valued at $375. Given under our hands and seals this 17th day of December 1842. G. W. Collier, Bright Best and Wm. D. Green Clk Wayne County NC Register of Deeds; Bk 19, pgs 536-537. --- John McKinne Slaves, 1841 & 1843 North Carolina, US, Wills and Probate Records, 1665-1998 In pursuance of an order of the Court of Pleas & Quarter Sessions I have advertised and sold the Negro boy Calvin mentioned in petition of Mary B. McKinne to James Everitt for $620 he being the last and highest bidder. Apr'l 3rd 1841 - Jno. A. Green (No date) - To the Worshipful the Justices of the Court of Pleas & Quarter Sessions of the county of Wayne. The Petition of Mary McKinney, widow of John McKinney, Wilbert J. Futrell and wife Hepsey, Robert McKinney and Mary McKinney guardian of Sarah, Mary and David McKinney infants under age respectfully sheweth to your Worships that John McKinney late of the county of Wayne died without his last will and testament and that John Everett administered on the estate of the said John McKinney sometime in the year 1839. They further state that they are distributees according to law of the estate of said John and now parties in lands, tenants in common of certain slaves viz: Kitty and her children Penny, Grip, Leylla, Jack & Junius and Olivia and her children Lewis and Cheny. They pray your Worships to order a division of the said slaves among them in severalty and that commissioners may be appointed to divide the same and they will in pray as in duty bound. John McKinne Division of Negroes - Recorded Feb'y Court 1843 Agreeable to an order of Court issued at Nov'r Term 1842 to us directed to divide the Negroes belonging to the estate of John McKinne dec'd your committee make the following report that they proceeded to value the Negroes and valued them at $1702.50 and divided them in six lots and find the average lot $283.75. Lot 1 drawn by Robert McKinne girl Olive valued at $325 and pays $41.25 to No 5. Lot 2 drawn by widow Mary McKinne girl Kitty valued at $325 and pays $51.25 to Lot 6. Lot 3 drawn by Hepsy Futrell wife of Wilbert J. Futrell boy Keder and girl Cheny valued at $325 and pays $7.50 to No 6. Lot 4 drawn by David boys Grip and Junius valued at $270 and receives $13.25 from No 3. Lot 5 drawn by Sarah McKinne girl Sella and Jack valued at $242.50 and receives $41.25 from No 1. Lot 6 drawn by Mary McKinne girl Moriah valued at $225 and receives $51.25 from No 2 and $7.50 from No 3. Which your committee respectfully submits. John Evertt JP and J. W. S. West ----- Indenture made 6 Nov 1817 between Richard Carraway and John McKinne Jun'r both of Wayne, for $3200 land in Wayne adjacent to Probert Colliers line near the head of the Short Branch, branch on the Hill, run of Caraway's Creek, the old mill, old Neuse Road, Great or Slocumb Marsh to my back line, formerly my Father, John Caraway's back line, it being the land which my said Father deeded to me by Deed of Gift this day and being all the land which he owned and on the north side of said lines and courses (acres not given). Witnesses: Elizabeth Carraway and J. Slocumb. Registered: February Term 1821. Wayne County, NC Register of Deeds; Bk 12, pg 114. (Richard was likely Polly Carraway McKinnie's brother and this land adjacent to the lands of his father John whose land was divided among his children in 1824. John and Polly were married by this time.) February 25, 1824 - Wayne County - In obedience to an Order of Court issued February Term 1824 we the Subscribers have been summoned and sworn by the Sheriff of sd county to lay off and divide the lands of John Caraway dec'd between the lawful heirs of sd dec'd: No 1 - Beg'n for John McKinnie land on the east side of Caraway Creek on the Mill Pond adjacent to the old Neuse Road, Collier's corner, run of Caraway Creek, John McKinnie's corner and containing 75 acres. One other tract (No 7) on the side of Goshen Road adjacent to Solomon Path, old Neuse Road and containing 84 acres. Wayne County, NC Register of Deeds; Bk 13, pg 109. Collier both of Wayne, for $325 land in Wayne known as lot No 5 in the division of the lands of John McKinnie and drawn by Mary McKinnie adjacent to a read oak David McKinnie's beginning corner, stake in the old Road, George W. Image Deed of Trust - 23 Feb 1847 - Know all men by these presents that I Mary McKinne Sr of the first part and John Everett, Mary McKinne Jr., J. W. S. West and Richard Washington, and George W. Collier of the third part mutually chosen by the parties of the first and second part as trustee of the third part. Witnesseth that the said Mary McKinne Sr. is indebted to: John Everitt due by note $111.83 date 30 Dec 1845 Robert McKinne Jr. security; to Mary McKinne Jr. by note $375 dated 23 Oct 1846; to John W. S. West by note $119.66 bearing date 19 Dec 1844 also by $18 due 1 Jun 1846. By recpt $10 due 1 Jan 1847 to Richard Washington and by note $196.28 bearing date 13 May 1840 John Everitt security, subject to the following credits $54.94 on 1 Jan 1841 - one other for 45.27 12 Dec 1842 also by rec't $213.81 on 21 Dec 1842. And whereas the said Mary McKinne Sr. being desirous to secure the payments of the said debts to said John Everitt, Mary McKinne Jr., J. W. S. West and Richard Washington. For one dollar to her in hand paid by the said George W Collier on the third part before the sealing and delivery of these presents the receipt of which is hereby acknowledged have granted bargained sold and conveyed unto the said George W. Collier in trust the following named property viz: One tract containing about 88 acres with the Mill thereon adjoining the lands of George W. Collier and William Carraway; also one tract the dower on which she now resides upon as set a part by the Jury appointed for that purpose in 1839. Also one Negro woman by the name of Kitty aged about 30 years, 2 horses, about 60 head of hogs, six head of cattle, four beds and furniture, all the house hold and kitchen furniture, all the bacon and pork and lard, all the corn, peas and fodder and farming utensils, one ox cart, one riding gig and harness, two grind stones, one loom, one spinning wheel, 17 head of geese, all of which the said George W. Collier agrees to and with the parties of the second part to set up and sell for cash whenever thereunto requested by the said parties of the second part after giving public notice thereof by advertisement for 20 days at the Court House and two other public places in the county and the money arising from such sale to apply to the payment of the before mentioned debts after deducting the expenses incurred by execution of this trust and the remainder of the money so arising if any to pay to the said Mary McKinne Sr her heirs executors administrators or assigns in Witness whereof we have hereunto set our hands and seals. Witness: D. B. Everitt. Registered: February 24, 1847. Wayne County, NC Register of Deeds; Bk 20, pg 290. Indenture between George W. Collier and John W. S. West both of Wayne executed by Mary McKinne Senior 23 Feb 1847 to Geo. W. Collier as trustee for purpose of securing debts therein enumerated the said Mary McKinne Senr. conveyed among other things one tract of land known as the dower of said Mary McKinne Senr. as allotted to her by the Jury appointed for that purpose in the year 1839 and on which the said Mary McKinne resided and whereas by virtue of the estate a power in said George W. Collier as trustee vested the said George W. Collier as trustee having duly advertised the day and place of sale as required in said deed on December 28, 1847 expose the aforesaid tract of land or dower to public sale when or where John W. S. West became the last and highest bidder therefore and the same was knocked off to the said John W. S. West for the sum of $40.30 and whereas the said John W. S West. had paid the said sum or secured the same. 21 Feb 1848, Witnesses: W. D. Cobb and James H. Everitt. Registered: April 5, 1853. Wayne County, NC Register of Deeds; Bk 23, pg 372. Sheriff Deed - 11 Sep 1847 - To all persons to whom these present shall come I Ollin Coor High Sheriff of Wayne by a writ issued unto the Court of Pleas and Quarter Sessions the third Monday of May 1847 last past and to the said Sheriff directed he was commanded that of the goods and chattels and in default thereof of the lands and tenements of Mary McKinne if to be found in his county she should cause to be made the sum of $369.85 with interest on the same of $327.62 from the 18th day of 1847 with A. C. Evans lately in the said court recovered for his debt and damages against the said Mary McKinne and which were then and there adjudged to the said A. C. Evans for his debt and damages and also the further sum of $9.75 which were then and there adjudged the said A. C. Evans for his costs and charges by him in said suit expended and whereof the said Mary McKinne was liable as appears of record - by virtue of said writ he had served and taken in execution two certain pieces or parcels of land in Wayne; one tract containing about 88 acres and with the Mill thereon adjoining the lands of Geo W. Collier, Wm. Carraway; one other tract being the dower of Mary McKinne whereon she now resides all which said land were under mortgage or conveyed by a deed in trust to Geo. W. Collier at the time of the levy on and sale of the same and whereas the said Sheriff having given due and legal notices of the time and place of sale of the said land did on the 17th day of Augt 1847 expose the same to sale by public vendue and sold to A. C. Evans for $245. Witnesses: Jno. A. Green and Waitman Thompson. Registered: Feb'y Court 1848. Wayne County, NC Register of Deeds; Bk 20, pg 543. Indenture made 21 Feb 1848 between George W. Collier and John W. S. West both of Wayne whereas by a deed in trust executed 23 Feb 1847 by Mary McKinne Senr. to George W. Collier as trustee one tract of land containing about 88 acres with the mill thereon adjoining the lands of George W. Collier and William Carraway and trustee advertised the day and place of sale did on 28 Dec of same year expose the tract of land to public sale when John W. S. West became the last and highest bidder for the sum of $242 George W. Collier has conveyed to John W. S. West all the interest conveyed to said George W. Collier as trustee by said Mary McKinne Senr. in said deed of trust in and to the aforesaid tract known as the Mill tract. Witnesses: W. D. Cobb and James W. Everett. Registered: 5 April 1853.
