#1443 – STATE vs ALLEN

NC Supreme Court Case found in the NC Archives – NC Reports states this was 
for both Wayne and Greene Counties

Allen, a slave, the property of William Dickinson – Wayne Co. Superior Court – 
To the Supreme Court June Term 1825 – filed 17 June 1825

At Wayne Superior Court the first Mon after the 4th Mon of March in 1825 – 
Bill of Indictment – Allen a slave owned by William Dickinson on 1 Nov 1824 
stole of the value of 20 shillings of the goods and chattels of Cornelius 
Outland – sd Allen said he was not guilty and hired Stephen Miller as his 
attorney – found guilty but a death sentence should not be papered – requests 
clergy – (NOTE: not sure what he stole but it may have been a steer) valued at 
twenty shillings – 

Superior Court in Greene Co – 2nd Mon after the fourth Mon of March 1822 – 
Allen Woodard late of the County of Greene on 1 March 1822 about 11:00 at 
night with force went to the house of Asa Daniel and broke in and entered with 
the intention of burglary – took 20 pieces of bacon worth 40 shillings – sd 
Allen Woodard was a colored man and he pleaded not guilty – the jury found him 
not guilty of felony burglary but guilty of grand larceny – requested clergy – 
received 39 lashes from the sheriff two different times – was given benefit of 
clergy – the prosecutor wanted death and was dissatisfied he did not get it 
and referred the case to the Supreme Court – the court appears to have 
affirmed the original judgment of whipping
