May 11, 1878 To W T Yelverton Probate Judge of said county I desire that R P Howell be appointed guardian of the estate of my son Phillip Casey and respectfully request ghzg you appoint the said R P Howell as such guardian May 11, 1878 R. Casey --- Phillip Casey vs R P Howell - Complaint before Probate Judge The plainrtiff complaining of the defendant alleges 1. That the defendant R P Howell was on the 16 day of May 1878 appointed guardian of the person and estate of the plaintiff Phillip Casey and took into his possession the estate of the said plaintiff which was considerable and that there is now in the hands of the defendant of the said estate about $2,600 to which the said Phillip Casey is well entitled. 2. That the said Phillip Casey on the 16 day of August 1880 became twenty one years of age and since that time has demanded a settlement by said defendant of his said guardianship and a payment to the plaintiff of the sum due him by virtue of said guardianship - hitherto the defendant has failed and refused to settle with and pay him the sum due as aforesaid. --- Phillip Casey vs R P Howell - Judgment Upon taking the account of R P Howell guardian of Phillip Casey asked for in the complaint in the above entitled action, after charging said Howell with the amount and interest thereon, received by him and giving him credit for his disbursements and 2 1/2 cents commissions on $2,870, there was found to be due to the plaintiff the sum of $2,572.75.
