HINES of Wayne Co., NC, Attorney 17 Nov. 1847-5 Feb. 1851 Know all men by these Presents that I, Lovit HINES of Greene County in the State of Alabama having been duly appointed and qualified as the administrator de bonis now of all and singular the Goods and Chattels, rights and credits which were of William GULLY deceased late of the County of Sumpter and State afors’d. and having also been appointed and qualified as the Guardian of the children and infant heirs of the said William GULLY to wit Jesse GULLY, Ezekiel S. GULLY, Sarah GULLY, Mary Ann GULLY and Susan M. GULLY. Now therefore I the said Lovit HINES, Admr. and guardian as afrs’d. have nominated, Constituted and appointed do by these presents nominate & constitute and appoint James M. HINES of Wayne and State of North Carolina my true and lawful Agent and Attorney for me and use my name to ask demand sue for and recover any suing or sums of money, property or rights of property, distributive share legacy or bequest which may be due owning or coming to the said William GULLY, his heirs, Exrs. & Admrs. or assigns from the estate of Ezekiel SLOCUMB and also any sum or sums of money distributive share, legacy or bequest due owing or coming to the said William GULLY his heirs, Exrs., Admrs. or assigns from the estate of the late Jesse GULLY, Dec’d. I supposed to be in the hands of Benjamin SMITH, Admr. of the estate of the said William GULLY in North Carolina and I do hereby authorize and empower the said James M. HINES to do all lawful acts for me and in my name as Admr. and Guardian as afors’d. for the recovery of the said monies, shares, legacies or bequests. And to compound settle, and assignee for the same, whatever it may be or whereas it may be found. And for me and in my name to make, sign, seal and deliver all necessary recipes and discharges for the same and for me and in my name to do all lawful acts whatsoever in the premises as fully as I might or could do, were I personally present. Hereby ratifying and confirming whatever my said Agent and Attorney may do or cause to be done in the premises. In Testimony whereof I hereunto subscribed my hand and seal this the fifth day of February A.D. 1851 Lovit HINES, Seal Signed, sealed and delivered in my presence of Wm.? WEBB The State of Alabama Sumpter County In the Orphans Court of Said County April Term, A.D. 1851 Bond Estate of William GULLY, Deceased The State of Alabama, Sumter County. Know all men by these presents that we Lovit HINES, William BOLTON, and Elizabeth HINES are held and firmly bound unto Gideon B. FRIERSON, Judge of the orphans court of said county in the sum of sixteen thousand dollars to be paid to the said Judge or to his succession in office, for which payment well and truly to be made, we bind ourselves our heirs, Executors and Administrators, jointly and severally firmly by these presents, sealed with our seals. This 17 day of November 1847. The condition of the above obligation is such. That whereas the above bound Lovit HINES has been duly appointed administrator of all and singular the goods and chattels, rights and credits of William GULLY deceased, not heretofore administered. Now if he shall well and truly perform all the duties which are or may by by law required of him as such administrators then the above obligation to be void otherwise to remain in full force. (Minister) Orphans Court Regular Term holden on the fourth Monday in April A.D. 1848 present his —— Preston G. MASTO, Judge Presiding, James HAIR former ad— having resigned his administration on said Estate upon application it is ordered by the Court Lovit HINES be and is hereby appointed administrator de Bonis non of all and singular the goods and chattels rights and credits of William GULLY, Dec’d and the clerk is ordered to issue to him letter accordingly he having given bond in the sum of sixteen thousand dollars and taken the oath required by law. ordered by the court that said administrator have leave to keep said Estate together for one year. It bing considered to the interest of the hits. Ordered by the court that said admire. have leave to see the crop privately. The State of Alabama Sumpter County I, Price WILLIAMS, Clerk of the County Court of said County (doing Orphan’s business) do hereby certify that the forgoing is a true Transcript of the records of the proceedings had in the case of Lovit HINES admr. of the Estate of William GULLY, deceases as appears of record in my office. Given under my hand and Seal of office at Livingston, the 24th day of April A. D. 1848. Price W. WILLIAM, Clerk. The State of Alabama Sumter County I, Preston G. NASH Judge of the County Court of said County do hereby certify that Price WILLIAMS whose genuine signature appears to the foregoing certificate which is undue form of Law is now and was at the time of signing the same Clerk of the County Court of said County duly commissioned and qualified and that full faith and credit are due and ought to be given to all his official acts as such. County The State of Alabama Sumter County Know all men by these presents, that we Lovit HINES, William BOLTON and Elizabeth HINES are held and firmly bound unto Gideon B. FRIMON, Judge of the orphans court of said County, and to his succession in office in the sum of sixteen thousand dollars for which payment will and truly to be made, we bind ourselves, our heirs, executors and administrators jointly and severally, firmly by these presents. Sealed with our seals and dated this 17th day of November, in the year of Our Lord 1847. The condition of the above obligation is such. That whereas the above bound Lovit HINES has been duly appointed Guardian to Jesse GULLY at the age of 18 years, Ezekiel S. GULLY of the age of 16 years, Sarah GULLY aged 14 years, Mary Ann, 12 years, Susan Margaret aged 10 years, minor heirs of William GULLY deceased. Now if the said Lovit HINES shall, well and truly perform all the duties which are or may be by law required of him as such guardian then the above obligation to be void, otherwise to remain in full force and effect. BOLTON, Seal Elizabeth HINES, Seal The State of Alabama Sumter County Personally appears before me Stephan S. POTTS and acting Justice of Peace in and for said County the within named Lovit HINES, William BOLTON, & E. HINES who severally acknowledged that they signed, sealed and delivered the within bond not eh day and year and for the uses and purposes therein contained as witness my hand and seal his 17 Nov. 1847. Sarah GULLY made choice of Lovit HINES to be her guardian in my presence. Stephen S. POTTS, Seal Orphans Court December 10th, 1847 upon application and it appearing to the satisfaction of the Court that the heirs herein after named who are over the age of fourteen years have made choice of said Lovitt it is therefore ordered but he court that -Lovit HINES be and is hereby appointed guardian of Jesse GULLY of the age of Eighteen years, Ezekiel S. GULLY of the age of sixteen years. Sarah GULLY aged 14 years, mary Ann GULLY aged twelve years, Susan Margaret GULLY aged about ten years minor heirs of William GULLY deceased and the Clerk is ordered to issue to him Letters accordingly he having given bond in the sum of sixteen thousand dollars conditioned according to law with William BOLTON & Elizabeth HINES securities. The State of Alabama Sumter County I, Price WILLIAMS, Clerk of the county court of said County, do hereby certify that the foregoing contains a true transcript of the appointment of Lovit HINES as Guardian of the minors & heirs of William GULLY deceased as fully and complete as the same is to be found of record a file in my office.
