Wayne County, NC - Milley & Howey Lane Petition, 1801 ~~~~~~~~~~~~~~~~~~~~~~~~~~ To the worshipful, the Justices of Wayne County Court. The Petition of MILLEY LANE and HOWEY LANE infants by WILLIAM SMITH, their guardian, humbly sheweth: That ISHAM LANE formerly of Wayne County, died intestate in the year ____ possessed of a considerable real and personal estate, administration upon which was granted to ISHAM LANE the younger and BRYAN LANE who by virtue of such appointment possessed themselves of the goods and chattels of their said intestate to the amount of three thery ? and pound and some other considerable sum, which was by law distributable among LEWERRY LANE, widow of the Intestate and BRYAN LANE, MATHEW, JOHN, CULLEN, BETHANEY, SALLY, PENNY, ELIZABETH and your petitioners, MILLEY and HOWEY, his only legitimate children. Your petitioners shew that ISHAM LANE and BRYAN LANE, administrators as aforesaid, caused these amounts as administrators to be stated and allotted to your petitioners the sum of (L 148.8.3 ps each), being one twelfth part of the balance remaining in their hands, the said administrators admitting that the said ISHAM LANE to retain a share of said balance as one of the distributees thereof. Whereas your petitioners charge that the said ISHAM LANE was only reputed to be the son of the said intestate, that he was not born in wedlock and was not legally intitled to any share of the property real or personal of his intestate. By which mode of division the share of your petitioners are each reduced L 23.9.15 below the sum to which they are entitled equally to the statement of their administrators made by the administrators themselves, which sum the said ISHAM and BRYAN LANE refuse to pay or secure for the benefit of your petitioners. To the end that the said ISHAM and BRYAN LANE may echibit a particular amount of the personal estate of the said ISHAM LANE deceased and of their administration thereof, that they may fully answer the ______ and may be decreed to pay your petitioners their full share of the personal property of their father, may it please your worships to grant writs of _______, directed to the said ISHAM LANE and BRYAN LANE commanding them to appear before your worships at the court to be held for Wayne County on the third Monday in August next to answer the ________ abide the _____ and decree of your worships in this premises, and your petitioners shall ever pray.
