Wayne County, NC - Wright Langston Heirs Petition, 1850 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ State of North Carolina In Equity Wayne County Spring Term 1850 The petition of CLARISSA LANGSTON, ALPHA ANN LANGSTON, JOHN LANGSTON and FRANCIS LANGSTON, infants by their next friend and guardian, WILLIAM K. LANE. To the Honorable the Judge in Equity for the county aforesaid. Your petitioners, the aforesaid CLARISSA LANGSTON, ALPHA ANN LANGSTON, JOHN LANGSTON and FRANCIS LANGSTON, suing by their next friend and guardian WILLIAM K. LANE, show unto your Honor that about two years ago, WRIGHT LANGSTON, their father, died intestate, possessed of a small personal estate, which has been entirely consumed in the payment of his debts. That your petitioners are of very tender age, the eldest not exceeding eight years. They show unto your Honor that their father the said WRIGHT LANGSTON died seized and possessed of a number of unimproved lots in the Town of Goldsboro, a portion of which have been sold by his administrator for paying debts and that there are now remaining unsold about, from sixty to sixty-five lots of half acre each adjoining each other; and that he also died seized and possessed of a tract of land adjoining said lots and that his widow took dower of the same, leaving about one hundred and fifty acres nearest the town now in the possession of your petitioners. Your petitioners shew unto your Honor that the said land is very poor and does not rent for more than enough to pay their taxes. That it is all clear-ed and worn out except a small piece of piney woods. Your petitioners further shew unto your Honor that they are altogether dependent on their mother, who is of small means, for support. They further shew unto your Honor that their town lots are taxed high, whereas they produce nothing for rent and they furthershew unto your Honor that real estate in and near said Town is selling high and as your petitioners have not the means of support and education for asmuch as their said real estate produces little as rent and as the same will now bring a good price.(This sentence inserted above the previous one. THAT IT MAY NOT CONTINUE WITHOUT BENEFIT TO THEM TILL THEIR ARRIVAL AT LAWFUL AGE.) They pray that your Honor will decree a sale of the same, in such convenient lots and upon such terms as your Honor shall think best. With the exception of the small piece of piney woods aforesaid which lies near the dower and will eventually be valuable for its timber in keeping up the fences around the same. Your petitioners are impressed with the belief that a sale of said real estate will condense materially to their interests. Your petitioners further shew unto your Honor that they are the only heirs at law of said WRIGHT LANGSTON and that the said WILLIAM K LANE, was at the last county court of this county appointed their guardian and gave bond with good and sufficient sureties. Your petitioners pray that your Honor will make such other and further orders and decrees as the orators of the case and their interests may demand. And as in duty bound they will ever pray.
