Bush, Charles Carraway, John Carraway Sen'r, Sam'l Cherry, Shadrack Daniel, Joseph Everett, William Frees, Joel Grantham, Willis Hall, Isaac Hill, Jas Hix, Thos Kannedy, Elijah Langston, Ira Langston, David McKinne, Jno McKinne, Michel McKinne, Wm McKinne, Solomon Pope, Jno Smith, Jesse Toler and Henry R Woodhouse. --- 3 May 1824 - David McKinne Guard'n vs John McKinne, Michael McKinne, Charles Carraway and Sally his wife - To Nov Term 1824 State of North Carolina To the Sheriff of Wayne County Whereas, an execution issued upon a judgment on a Warrant, tried before me James Carraway Esquire, one of the Justices of the Peace for Wayne County, against John McKinne Adm'r of Mat'h McKinne deceased, at the suit of David McKinne Guard'n for the sum of $57.80 and costs; which execution was returned to the Court of Pleas & Quarter Sessions held for Wayne County at Waynesborough on the 3d Monday of May AD 1824 - Levied on the lands of Mat'h McKinne dec'd adjoining the lands of David McKinne and others the report of the defendant's McKinne and whereas the said John McKinne has suggested that the said lands have descended to John McKinne, David McKinne, Michael McKinne, Charles Carraway and Sally his wife heirs at law of the said defendant's McKinne and the said plaintiff having solicted some fit remedy in this behalf, and we willing what is right should be done: Command you, that you make known to the said John McKinne, David McKinne, Michael McKinne, Charles Carraway and Sally his wife heirs of the aforesaid Mat'h McKinne and command them to appear before the Justices of our said Court, at the Court to be held for Wayne County at the Court House in Waynesborough on the 3d Monday of November next, to shew cause, if any they have, wherefore the said David McKinne Guard'n should have execution against the lands of the said Mat'h McKinne deceased, levied upon as aforesaid to satisfy said judgment, interest and costs and further to do and whatsoever our said court shall order and decree in the premises. Herein fail not, and have you then and there this writ.
