The following information is found in the estate papers of John McKinne. State of North Carolina County of Wayne Court of Pleas & Quarter Sessions Nov'r Term 1839 Petition for Dower To the worshipful the Justices of said Court The petition of Mary McKinne humbly complaining therewith unto our worships that sometime in the month of [blank] in the year of our Lord 1839 John McKinne departed this life intestate leaving him surviving your petitioner his widow. Your petitioner further represents that said John McKinne left children and heirs at law the following persons Bryant McKinne and Hepsy McKinne who are of lawful age and Mary, Robert, Sarah and David McKinne who are infants under the age of 21 years and who have no guardian. Your petitioner further shews that her said husband died seized and possessed of a certain tract of land in said county containing about 300 acres adjoining the lands of George Collier, William Carraway and Junius G. Slocumb which descended to his said heirs at law subject to your petitioners right of dower. Your petitioner prays of your worships to issue a writ of Dower directed to the Sheriff of said county commanding him to summon a jury of good and lawful men to proceed to the premises to allot and lay off her dower by metes and bounds according to law and such other and further relief grant as your petitioner may of rights and in law ask and as in duty bound she will ever pray &c. Green appointed guardian ad litem to infant heirs ---------- State of North Carolina Wayne County County Court Nov'r Term 1839 To the worshipful the Justices of the Court of Pleas and Quarter Sessions for the county aforesaid. The Petition of Mary McKinne respectfully sheweth unto your worships, that her husband John McKinne departed this life during the month of [blank] last leaving her as his widow and entitled as such to a years allowance out of the crop stock and provisions of her said husband. Your petitioner further sheweth unto your worships that John Everitt of the county aforesaid has taken out letters of administration upon the goods and chattels rights and credits of her husband. Your petitioner therefore prays your worships that John Slocumb, John West and Bright Best may be appointed to lay off and allot to her her years allowance out of the estate of her husband and report to the next term of the court and your petitioner as in duty bound will ever pray. &c W. The petition of Mary McKinne, widow of John McKinne, Wilbert J. Futrell & wife Hepsy, Robert McKinne and Mary McKinne guardian of Sarah, Mary and David McKinne infants under age, respectfully sheweth to your worships that John McKinne late of the county of Wayne dec'd without his last will and testament and that John Everitt administrated on the estate of said John McKinne sometime in the year 1839. They further state that they are distributees according to law of the estate of said John and are tenants in common of certain slaves viz: Kitty and her children, Penny, Grip, Leylla, Jack and Junius, Olifos?, Olivia and her children Lewis and Cherry. They pray your worships to order a division of the said slaves among them in severalty and that commissioners may be appointed according to the act of assembly to divide the same and they will ever pray in duty bound.
