Wayne County, NC - Needham Waters Estate, Partition of Lands, 1857 ~~~~~~~~~~~~~~~~~~~~~~~~~ State of North Carolina Superior Court of Law Wayne County Fall Term A D 1857 To the Honorable the Judge of the Superior Court of said County. The petition of LEMUEL SUTTON and wife EASTHER, JOHN B. WATERS and MARTHA WATERS, the two last by their next friend & guardian, PENELOPE WATERS, all of said county respectfully sheweth unto your Worships that NEEDHAM WATERS of the county of Wayne dec'd, was in his lifetime, and at the time of his death, seized in fee simple as of some other good estate, of inheritance to him and his heirs, of three several piece, parcels or tracts of land, and one tract lying in Wayne County on the waters of Walnut Creek adjoining the lands of JOHN WOOTEN, ELIJAH BIZZELL and FRANKLIN WHITFIELD containing three hundred and fifty three acres, (353) one other tract lying and being in Lenoir County on the waters of Neuse River adjoining the lands of WILLIAM DAWSON, JEREMIAH WATERS & others containing three hundred and twenty acres (320). Also one other tract lying and being in Greene County, adjoining the lands of AVY FARMER, ELI JONES and others containing sixty-eight and one-half acres, (68 1/2). (THIS 68 1/2 ACRES WAS PENELOPE HILL'S INHEIRITANCE FROM HER FATHER RICHARD HILL'S ESTATE.) And being so seized, the said NEEDHAM WATERS did depart this life intestate leaving EASTHER wife of LEMUEL SUTTON, JOHN B. WATERS and MARTHA WATERS his children and heirs at law him surviving and upon his death the said lands descended and came to your petitioners as tenants in common in the proparation of one third to each. Your petitioners further show unto your Honor, that they are desirous of having a fair, just and equal partition of said lands made between them, in order that their respective shares and proparations thereof may be allotted, held and enjoyed in severalty. To the end therefore, that a partition may be made of said lands between your petitioners; that each one's share or proparation then may be allotted and conveyed to them and their heirs and assigns; and that your petitioners may severally hold and enjoy their respective allotments of said lands, according to the nature thereof, in severalty, and that all proper & necessary conveyances and assurances may be executed for carrying such partition into effect, And that your petitioners may have such other and relief in the premises as the nature and circumstances of this case may require, and to your Honor shall deem ____ and proper. May it please your Honor to appoint five commissioners to divide and appropriate said lands between your petitioners, as herein before prayed for, According to the act of the general Assembly in such cases, made and provided, as to your Honor shall deem proper and requisite.
