Be it enacted that the citizens of the town of Waynesboro in the county of Wayne be and the same are hereby incorporated and entitled to all the privileges as well as liabilities of corporate bodies. 2. Be it enacted - That Lemuel H. Whitfield, Ira Langston and John C. Slocumb Esqrs of the county of Wayne or either of them be and the same are hereby appointed to hold an election at the Court House in Waynesboro on the 1st Monday of February next for the purpose of electing a Magistrate of Police and four Commissioners. 3. Be it enacted - That in said election and in all succeeding elections all free white male citizens of the age of twenty one years who have resided within the limits of said town for three months immediately proceeding the day of said election or who are owners of real estate liable to taxation in said town shall be entitled to vote. 4. Be it further enacted - That the said Magistrate of Police and four commissioners who shall be resident of said town or any three of them shall have and possess the usual powers of corporate bodies and shall make any laws necessary for the regulation of said town not inconsistent with the laws of the state - The shall lay such taxes as they think needed and cause them to be collected, they shall cause the streets to be kept in order, may abate and remove all nuicances, appoint and support such patrols as shall be needed. They shall appoint an overseer of the streets and town constable, a treasurer and clerk, whose duties shall be defined by them previous to their appointment, and transact all business brought before them relating to the interest or welfare of said town. 5. Be it further enacted - That if any person elected to office in said town election or any future election shall refuse to accept and serve in the office to which he shall be elected, he shall forfiet and pay to the Treasurer, and in case no Treasurer, to the sheriff of the county the sum of twenty dollars for the use of said town to be collected by warrant to be issued by any Justice of the Peace on application by any citizen of the town. 6. Be it enacted - That if any person appointed by the Magistrate of Police and commissioners to any office above named who shall refuse to accept and serve, the same shall forfiet and pay into the treasury of the town the sum of fifteen dollars to be collected by warrant as aforesaid provided no person shall be compelled to serve more than two years in three and shall not be liable to such fine more than once in each year. 7. Be it enacted - That the Treasurer, Clerk, Town Constable and overseer of streets for neglect of duty be liable to such fine as the Magistrate of Police and commissioners shall think proper not exceeding fifteen dollars. 8. Be it enacted - That it shall be the duty of the Magistrate of Police to preside if present at all meetings of the commissioners, to sign such laws and orders as may be passed and cause them to be made public, he shall command and regulate patrols and shall possess the same power to punish disorderly persons and vagrants as is given by the laws of the state to Justices of the Peace, shall see that the town officers do their duty and enforce the observance of all Bye Laws enacted by the corporation, shall publish ten days notice previous to each annual election which shall be held at the courthouse on the 1st Monday of February of each and every year under the same rules and regulations as prescribed in 3rd section of this act which shall be held by the Magistrate of Police. He shall hold his office for one year from the time of his appointment and until another is appointed for neglect of any of the duties as above prescribed, he shall be subject to a fine of five dollars to be collected by warrant from any Justice of the Peace and applied to the use of the town. 9. Be it enacted - That in case of any vacancy in the office of Magistrate of Police or commissioners occurring during the year, the remaining members of the Board shall be and are hereby authorized to fill said vacancy until the next annual election. 10. Be it further enacted that the treasurer shall be required to give a public statement of the monies received and how expended at each and every annual election. 11. And be it further enacted - That all laws and clauses of laws, coming within the purview and meaning of this act be and the same are hereby repealed. To the Hon. the General Assembly of the State of North Carolina, the undersigned citizens resident in the town of Waynesboro or owners of property liable to taxation in said town respectfully petition. That all laws relating to said town of Waynesboro be repealed and that the town of Waynesboro be incorporated according to the bill accompanying this Petition. Henry M. Jeter Saml. A. Andrews Jno. A.
