Hudson Source: www.familysearch.org Wayne Deed Records 1890-1893 Image 78 or 831 Volume 64 page 91 State of North Carolina Wayne County This indenture made 30th day January 1891 between James R. Brown and wife M.L. Brown of the first part and C.J. Hudson of the second part of the county of Wayne state of North Carolina witnesseth that said party of the first part in consideration of five dollars to them paid the receipt of which is hereby acknowledged have bargained and sold by these presents do convey unto the party of the second part and his heirs a certain tract of land lying in Grantham township Wayne County in said sate and is bounded as follows: (1) one third interest (now undivided) in a tract or parcel of land known as the Job Warrick (dec'd) old homestead and conveyed to Clarissa Warrick by will of said Job Warrick, Sr. dec'd on or about the month of Dec. 1879 and after the death of said Clarissa Warrick (now Clarissa Sills) to descend to Jas R. Brown, A.W. Brown and Joe S. Brown for further description see will recorded in Clerk's office of Wayne County also a division of the land of the aforesaid Job Warrick, dec'd and recorded in Registers Office for Wayne county. To have and to hold the aforesaid tract of land to the party of the second part and his heirs and assigns forever And the parties of the first part for themselves their heirs, executors and administrators and assigns they are seized of said premises in fee that the same are free from all incumbrances and that they will warrant and defend said title of the same against the lawful claims of all person. The condition of the deed is that whereas the said part justly indebted to said party of the second part in the sum of one hundred and forty dollars by one note bearing interest at 8% and due Nov. 1, 1891 dated herein and is honestly desirous of securing the payment of the same. Now therefore if the said parties of the first part shall pay off and discharge said due when due and the interest accruing thereon then this deed shall be void. And it is further understood and agreed that in case the said part of the first part shall fail to pay off said note and interest when due then said note to become payable at once and the part of the second part of his assigns is authorized and empowered to advertise said land at Court House door and three other public places in Wayne County for thirty days and after such advertisement sell the same for cash at the Court House Door in Goldsboro and convey the same by deed to the purchaser and out of the proceeds of such sale pay the said debt and interest and all necessary expense of making and executing this trust and the balance remaining he shall pay over to said J.R. Brown and Clarissa Sills being by me privately examined separate and apart from their husbands touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fer or compulsion of her said husband or any other person and she doth still voluntarily assent thereto.
