Cox and wife E.E. Cox of the first part and C.J. Hudson or the second part, of the County of Wayne and State of North Carolina. Witnesseth, the said parties of the first part in consideration of five dollar to them paid, the receipt of which is hereby acknowledged have bargained and sold and by these presents do convey unto the said part of the second part and his heirs a certain tract of land lying in Grantham township Wayne County, in said state and bounded as follows: Containing 200 acres more or less, adjoining the lands of Julius H. Rayner, Henry C. Holmes and heirs of DP Jordan, being a half interest in the lands on which the late Richard Rayner resident at the time of his death wand being the lands or ½ interest in the lands assigned to Richard Rayner in his Homestead and in the Report of the appraisers described as follows: Richard Rayner entire ½ interest in his residence or home tract place of 400 acres it being the purpose and intent to convey herein all the interest of the said Richard Rayner in said lands being the property and interest conveyed by Julius H. Raynera dest. Of rich. Rayner dec'd by deed of this date to E.E. Cox. To have and to hold the aforesaid tract of land to the said part of the second part and h__ heirs and assigns forever. And the party of the first part for themselves, their heirs executors and administrators do covenant to and with the party of the second part his heirs, executors, administrators and assigns that they are seized of said premises in fee that the same are free from all incumbrances and that they will warrant and defend said title of the same, against the lawful claims of all persons. The condition of the deed is that whereas the said party of the first Part J.F. Cox justly indebted to the said party of the second part the sum of six hundred (600) dollars by one note bearing interest at ____percent from date payable on the 1st day of 1895. Dated herewith and is honestly desirous of securing the payment of the same. Now Therefore if the party of the first part shall pay off and discharge said debt when due and the interest accruing off said note and interest when due then the part of the second part or his assigns is authorized and empowered to advertise said land at the Court House Door and three other public places in Wayne County for thirty days and after such advertisement sell the same for cash, at the Court House Door in Goldsboro and convey the same by deed to the purchaser and out of the proceeds of such sale pay the said debt and interest and all necessary expense of making and executing this trust and the balance remaining he shall pay over to the said E.E.Cox or her legal representatives. Cox and Emma E. cox his wife personally appeared before me this day and acknowledged the due execution of the annexed deed and the said Emma E. Cox begin by me privately examined, separate and apart from her said husband touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fear of compulsion of her said husband or any other person and that she doth still voluntarily assent thereto. Let it be registered.
