K. Lane are hereby held and firmly bound to the Wilmington and Raleigh Rail Road company in the just and full sum of three hundred dollars for the payment of which will and truly to be made we bind ourselves our heirs executors administrators and assigns firmly severally and jointly by these presents witness our hands and seals this 20th day of February in the year 1838. The condition of the above obligation is that whereas the said John Everitt Guardian of David Everitt of the county of Wayne and State of North Carolina has this day agreed with the President and Directors of the Wilmington and Raleigh Rail road company that for and in consideration of the just and full sum of one hundred and twenty four dollars and sixty five cents to him in hand paid by the President and Directors of said company the receipt whereof is hereby acknowledged and that said rail road company is hereby authorized and empowered to construct their rail road through the land of his said ward David Everitt situated in the county of Wayne and State aforesaid adjoining the lands of John W. S. West, Samuel Smith and others agreeable to the terms prescribed in the charter of said company that is to say he grants to said company the road way and sixty five feet on each side of the base thereof as said road is now located through the lands of the said David. Now should the above bounden John Everitt and William K. Lane well and truly cause the said David Everitt to make a good and valid title for the said roadway as above described to the said Wilmington and Raleigh Rail Road company upon the coming of age of the said David Everitt or in case of his death that they will cause his legal representatives to make such good and valid title then this obligation to be null and void otherwise to remain in full force and effect Witness the hands and seals of the said John Everitt and (blank) this day and year hereinafter recited.
