Thomas & Caroline E. Fitsgerald to Ann W. Hooks

This indenture made and entered into this 23d day of August AD 1854 by and 
between Thomas Fitsgerald and Caroline E. his wife of the county of Penola and 
State of Mississippi of the one part and Ann W. Hooks of the county of Wayne and 
State of North Carolina of Thomas Fitsgerald and Caroline E. his wife for and in 
consideration of the sum of one hundred and fifty dollars to them in hand paid by 
the said Ann W. Hooks or secured to be paid the receipt whereof is hereby 
acknowledged they the said Thos. Fitsgerald and Caroline E. his wife have 
bargained sold conveyed and confirmed unto the said Ann W. Hooks her heirs and 
assigns forever all their right title and interest in and to the houses and lots 
in the Village of Everettsville whereon the said Ann W. Hooks now lives which was 
willed to the said Caroline E. Fitsgerald by her father the late Curtis Hooks 
after the death of said Ann W. Hooks. To have and to hold the said lots and 
improvements to her the said Ann W. Hooks her heirs and assigns forever and the 
said Thomas Fitsgerald and wife Caroline E. will by these presents warrant and 
forever defend the right and title to the same to her the said Ann W. Hooks and 
her heirs forever. In testimony whereof the said Thomas Fitsgerald and Caroline 
E. his wife have hereunto set their hands and seals the day and date above 
written.

Then was the above deed of sale from Thomas Fitsgerald and wife Caroline E. to 
Ann W. Hooks duly acknowledged in open court and at the same time the said 
Caroline E. Fitsgerald a feme covert and wife of said Thos. Fitsgerald she being 
then and there in open court was examined privately separately and apart from her 
said husband by Wm. Lane Esqr a member of the court now sitting (he having been 
appointed for that purpose) touching and concerning the due execution thereof by 
her the said Caroline E. Fitsgerald did confess and acknowledge that she executed 
the same freely voluntarily and of her own accord without the fear persuasion or 
compulsion of her said husband and that she doth now freely assent thereto. 
Ordered that said deed and this examination be registered. Benj. Aycock  Clk
