Wayne County, NC - Benjamin & Rachel Garris to John Harris, 1834 ~~~~~~~~~~ Wayne County May Term 1834 This indenture made this the 15th day of May in the year of our Lord One Thousand Eight Hundred and Thirty four between Benjamin GARRIS and Rachel GARRIS his wife of the state of North Carolina and Wayne County of the one part and John Harris of the State of North Carolina and County aforesaid of the other part Witnesseth that the said Benjamin GARRIS and Rachel his wife for and in consideration of the sum of Twenty five dollars to them in hand paid by the said John HARRIS the receipt and payment whereof they hereby acknowledge have granted bargains and sold by these presents do grant bargain and sell unto the said John HARRIS the undivided seventh part of a certain Tract of land situated lying and being the county aforesaid on a branch of the North East Called the little horsepen containing by estimation one hundred acres be the same more or less it being a part of a survey granted to Samuel HERRING for 400 acres and sold and conveyed to Bazzel KORNEGAY by the Sheriff of Duplin County this deed baring date the 10th December One thousand Eight Hundred and Seven by Bazzell KORNEGAY convey to John HARRIS, senior by deed baring date 16th day of October 1819 and divided by the last will and testament of the said John HARRIS senior to his seven daughters, Penelope, Elizabeth, Nancy, Rachel, Sally, Susan, and Eadith the said land being _______ and bounded as follows______, Beginning at the ________ edge of said horsepen branch-Thomas Ayers old corner and runs south 176 poles to a stake in an old line then along the South 65 West 75 poles to a stake and Jack then North 40 West 110 poles to a water oak on the side of said branch then up the same as it meanders to the beginning to have and to hold the aforesaid bargain premises with appurtenances and priviledges thereunto belonging or in any wise appertaining to unto the said John HARRIS his heirs and assigns forever and the said Benjamin GARRIS and Rachel his wife do further covenant and agree to and with the said John HARRIS his heirs and assigns to forever warrant and defend against the lawful claim or claims of all persons whatsoever in _____where of they have hereunto set their hands and seals this day and year first above written, sealed and delivered in presents of Benj GARRIS (seal) Urban LEWIS Rachel GARRIS (seal) Wayne County May Term 1834 Then was the within deed of sale from Benj. GARRIS and Rachel GARRIS his wife to John HARRIS duly acknowledge in open court at the same time the said Rachel Garris affirm convey Said wife of Benj. GARRIS being the other in open court examined by Gabriel SHERARD, Esquire one of the Justice of the court of Pleas and Quarters Sessions and a member of the court then setting the said Gabriel SHERARD being appointed for that purpose and privately, examined and apart from her husband. Touching the execution thereof by her the said Rachel GARRIS did confess and acknowledge that she executed the same freely voluntary and without fear of persuasion or compulsion of her said husband and that she doth now freely absent there to order that said deed and this examination be registered.
