This indenture made this Jan. 14 A.D. 1901 between A.J. Herring of the 
county of Wayne State of NC of the first part and Mary Hudson of the county 
of Sampson State of NC of the 2nd part witnessed that said party of the 
first part inconsideration of the sum of $1090.00 in hand paid by the 2nd 
part receipt of which is hereby acknowledged, bargained and sold and by 
these presents does convey unto party of the 2nd part her heirs and assigns 
forever the following piece or parcel of land in Grantham Township Wayne 
county and state aforesaid Know and designated as follows : adjoining the 
lands of G.E. Grantham, J.B. Kennedy, W.K. Grantham and others beginning at 
the black gum on the run of Rain branch and runs S58E 5 poles to a stake on 
the road than with the road about N16E 192poles then N55W 166 poles to a 
pine down H. Bizzle's corner then with his line S46W 11poles to a stake on 
the east side of a small then his other line N47W 46poles to a stake 
Bridgers line then with Bridgers line passing his corner S55W 86poles to a 
stake on the ditch in Horse Swamp Warrick's corner then his line S43E 105 
poles to a ---- on the run of Rain branch then down run of said branch 
containing 218 acres more or less being the land this day purchased by A.J. 
Herring from Mary Hudson to have and to hold with all the heretainments and 
appurtenance there to appertaining to her the said Mary Hudson her heirs and 
assigns forever and the said A.J. Herring party of the first part covenants 
with the said party of the 2nd part her heirs and assigns as follows 1st 
that he is the owner and lawfully seized of said premises 2nd that he has a 
good right to convey the same 3rd that the same are free of incumbrances 4th 
that he will warrant and defend the title to the same against all lawful 
claims.  Provided nevertheless that if the said A.J. Herring his heirs, 
executors, administrators shall pay the said Mary Hudson her heirs, 
executors, administrators and assigns the sum of one thousand and twenty 
dollars according to the condition of 10 bonds of ever date herewith payable 
on Jan 1 1902, 1903, 1904, 1905, 1906, 1907, 1908, 1909, 1910, 1911 
respectively then the deed will be null and void otherwise to be in full 
force and effect.  But if default shall be made in the payment of said sum 
of money or the interest or any part thereof at the time herein afore stated 
for the payment thereof the party of the first part does hereby fully 
empower the party of the second her heirs and assigns to sell said land at 
public outcry after first advertising for 30 days at Court House door and 
three public places in Wayne county and convey the same in fee simple to 
purchaser and out of the money arising from such sale to retain the 
principle and interest then on said ------and all costs and charges and pay 
any surplus to party of the first part of his heirs and assigns.  In 
testimony whereof the party of the first part has here set his hand and 
seal.
