Daniels Source www.familysearch.org Wayne Deed Records 1892-1895 Image 574a Book 67 Page 325 State of North Carolina Wayne County This in indenture made this 12th day of January 1893 between C.J. Hudson and wife Mary Hudson of Sampson County of the first part and A.W. Daniels of the second part of the county of Wayne and State of North Carolina. Witnesseth that said parties of the first part in consideration of five dollars to them paid the receipt of which is hereby acknowledged have bargained and sold and by these presents do convey unto the said party of the second part and their heirs and assigns a certain tract of land lying in Grantham township, Wayne County in the State and bounded as follows: Adjoining the lands of J.H. Grantham, G.E. Grantham and others being lot no.2 in the division of the lands of Hiram Grantham dec'd registered in Book 43 page 342 office of the Register of Deeds of said County and bounded as follows: Beginning at a lightwood stake J.H. Grantham's corner and runs S70½E 230¼ poles to a pine; then N1?E 96poles to a small water oak in the middle of the old road then with the old road S33&1/2W 19 poles then S1&1/2W 76poles to the beginning containing 186&1/2 acres more or less. To have and hold the aforesaid tract of land to the said party of the second part and his heirs and assigns forever. The parties of the first part for themselves, their heirs, executors and administrators do covenant to and with the party of the second part his heirs, executors, administrators and assigns that they are seized of said premises in fee, that the same are free from all incumbrances that they will warrant and defend said title of the same, against the lawful claims of all persons. The condition of the deed is that whereas the said parties of the first part are justly indebted to the said party of the second part in the sum of six hundred (600) dollars by a note bearing interest at 8 percent from date till paid interest payable annually on January 12th of each year payable January 12, 1896 dated herewith and are honestly desirous of securing the payment of the same. Now therefore if the said parties of the first part shall pay off and discharge said debt when due and the interest accruing thereon then this deed shall be void. And it is further understood and agreed that in case the said party of the first part shall fail to pay off said note or the interest therein or either the whole of said note to become due and payable at once even this not due by the term and the part of the second part or his assigns is authorized and empowered to advertise said land at the Court House Door and three other public places in Wayne County for thirty days and after such advertisement sell the same for cash at the Court House Door in Goldsboro and convey the same by deed to the purchaser and out of the proceeds of such sale pay the said debt and interest and al necessary expenses of making and executing this trust and the balance remaining shall pay over to said Mary Hudson or her legal representatives. Faison, FP for said County do hereby certify that C.J. Hudson and Mary Hudson, his wife personally appeared before me this day and acknowledged the due execution of the annexed deed and the said Mary Hudson being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or any other person and that she doth still voluntarily assent thereto. Herring CfC do hereby certify that the execution of the foregoing instrument has been duly proven as appears from the foregoing certificates and seals 17 day of January 1894 C.F. Herring CFC North Carolina, Sampson County. The foregoing certificate of J.F. Faison a Justice of the Pearce of Sampson County adjudged to be correct and I certify that J.F. Faison was at time of the signing the foregoing certificate a Justice of Peace of Sampson County and that his signature thereto is in his own proper handwriting.
