Deed Of Sale Deed Book___Pages 357 & 358 This Indenture made the 18th day of February in the year of our Lord One Thousand Eight Hundred and Thirty Two between Bryan Lane and Penelope Lane, his wife, Daniel Underhill and Elizabeth Underhill, his wife, and Thomas Reaves and Mary Reaves his wife, all of the State of North Carolina and Wayne County of the one part & John Harris of the State and County, of the other part witnessed that the said Bryan Lane & Penelope, his wife, Daniel Underhill & Elizabeth His wife, & Thomas Reaves & Nancy, his wife, for in consideration of the sum of seventy dollars to them in hand paid by the said John Harris the receipt & payment whereof is hereby acknowledged have granted bargained & lot & by these presents do grant bargain & sell unto the said John Harris three undivided sevenths part of a tract of land situate lying & being in the County aforesaid on a branch of the North East called the Little Horse Pens. Containing by estimation one hundred acres be the same more or less. It being a part of a survey granted to Samuel Herring for 400 acres and sold & conveyed to Bazil Kornegay by the Sheriff of Duplin County the deed bearing the date 10th December 1807 and by the said Bazil Kornegay conveyed to John Harris sent by Deed bearing date the 10th day of October 1819 & devised by the by the last Will & Testament of said John Harris Senr. To his seven Daughters Penelope, Elizabeth, Nancy, Rachel, Sally, Susan, & Edith the said lands being butted & bounded as follows ____Beginning at a pine in the edge of said Horse Pen Branch Thomas Aryns old corner and runs S. 176 poles to a Stake in an old line thence along the same So.65 ___75 poles to a Stake & Back then No. 40 West 110 poles to a water oak in the side of said branch then up the same as it meanders to the beginning. Touching the execution of said deed & let it be registered State of North Carolina R Hooks Clk Continued Wayne County In pursuance of the annexed commissions to us direct we have this day examanied the said Penelope, Lane Elizabeth Underhill & Nancy Reaves privately & apart from husbands touching this from consent in executing this within deed of conveyance when they & each of them did acknowledge that they did execute the same freely of their own accord and without fear or compulsion of the said Bryan Lane Daniel Underhill & Thomas Reaves their said husbands Given under our hand and seal thid 2nd day of March 1832 N Washington JP. Wayne County To Nicholas Washington & Jas Griswote Greeting Whereas John Harris hathe proved a deed of conveyance made to him from Bryan Lane & Penelope his wife Daniel Underhill and Elizabeth his wife & Thomas Reaves & Nancy his wife of a certain tract or parcel of land lying and being in the County of Wayne in the State of North Carolina and presumed the same to be proved by James Herring in the court of Pleas & Quarter Sessions of our county of Wayne, and it being reproven to our said court that Penelope, Elizabeth & Nancy wives of the said Bryan, Daniel, & Thomas is so infirm that they cannot travel to the said court of our county of Wayne to be privily Examined as to their free consent in executing the said conveyance Therefore we command you that at such certain day & place as you shall think fit you go to the said Elizabeth, Penelope & Nancy whether they executed the said conveyance freely of their own accord without fear or compulsion of the said Bryan, Daniel & Thomas their husbands and this examanation being distinctly & plainly wrote on the said deed or on same paper annexed thereunto and when you shall have so taken the said Examanation you are to send this ___________________________________________________________________ Copyright.
