Witnesseth that the said parties of the first part have agreed to purchase from Newman Potts and his heirs a certain tract or parcel of land which is fully described in bond to make title from the said Newman Potts from the said Richard and Thomas Mozingo for the consideration of purchasing said land on time which is in a high state of cultivation and for the further consideration that no damage may occur to the said Potts or his heirs do hereby agree to bind ourselves that in case of failure to fully pay off or discharge any of said notes at or before they become due that all the crops grown on said land for such year when any note remains unpaid shall be held by the said Newman Potts or his heirs for the payment of said notes and interest and that no part of said crops shall be removed from said premises until the sd Potts or his heirs agree to the same and it is further agreed and expressly understood that the farm is to be kept up in a good and farm like manner as it is at present all ditches and fences to be shrubbed out and kept in good order, fences to be kept in a good and lawful condition and no part of said land to be pastured or any timber sold from said land and for the year 1881 a three horse … to be cultivated and in case of refusing or failing to make full payment, the said Richard Mozingo and Thos. Mozingo is to deliver to the said Newman Potts or his heirs thirty six hundred pounds of good lint cotton and the seed out of same as rents for said farm and give up possession of any subsequent year the crops to be designated and laid off by the said Newman Potts which crop shall not be less than a two horse crop and rents to be as first year and it is further agreed and expressly understood that is the said Richard Mozingo and Thomas Mozingo shall violate any of the terms of this contract that the bond shall be forfeit, and of no effect and that they may be ejected by the said Newman Potts or his heirs. To this agreement we bind ourselves our heirs and legal representatives as well as ourselves. In testimony of which we have hereunto set our hands and seals, day and date above written. R. F. Mozingo and his wife Annie Mozingo and Thomas Mozingo appeared before me this day and acknowledged due execution of the annexed deed and the said Annie Mozingo being by me privately examined separate and apart from her said husband touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or any other person and that she doth still voluntarily assent thereto.
