Andrews Lots 37 & 38 Wayne County Deed Book 21, pgs 116-117 Deed of Trust State of North Carolina Wayne County This Indenture made and executed this 10th day of Oct'r AD one thousand eight hundred & forty eight by and between William R. Musgrave of the county of Wayne and state aforesaid of the first part, William Hollowell of the same county and state of the second part, Richard Washington, John Wright & W. S. G. Andrews of the third part Witnesseth that whereas the said R. Washington and J. Wright are bound as surities for the said William R. Musgrave for the sum of five thousand dollars due by note payable to T. C. Garrison due 1st July 1848 and also one other note for the sum of five hundred dollars payable to the said T. C. Garrison due 1st Jany 1849 also in one other note for the sum of five hundred dollars payable to the said T. C. Garrison due 1st July 1849 and whereas the said Wm. R. Musgrave is indebted to John Wright in the sum of four hundred & twenty eight 86/100 dollars due by note and is also indebted to Richard Washington in the sum of one hundred and fifteen 30/100 dollars due by note and is also indebted to the said Rich'd Washington and W. S. G. Andrews trading under the name of style of Washington & Andrews in the sum of eighty one dollars and whereas the said Wm. R. Musgrave is honestly desirous to secure the payment of the aforesaid debts and also to save harmless and in indemnify the aforementioned surities; now therefore the indenture of the premises as well as for the sum of one dollar to him in hand paid by the said William Hollowell at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged bargained and sold and delivered and by these presents do bargain sell and deliver unto the said William Hollowell two lots and the houses and improvements thereon situate in the Town of Everittsville in the county and state aforesaid known in the plan of the said town as lots Nos. 37 & 38 and being the same whereon John Wright now resides and also on the lot of land situate in the Town of Waynesboro in the said county and state containing about half an acre more or less known in the plan of said town as lot No 98 together with all the improvements thereon consisting of a steam saw mill and every article thereunto belonging or in any wise appurtaining to him the said William Hollowell his heirs and assigns forever in special trust and confidence nevertheless and the said William Hollowell doth hereby consent and agree that he the said William Hollowell shall and will hold all and every lot and other property hereby conveyed to the uses and intents following and no other that is to say that the said William Hollowell shall when thereunto required by the parties of the third part expose to public sale and sell for cash all the property hereby conveyed having given twenty days previous notice of the same at Waynesboro and Everittsville and two other places in said county and the proceeds of said sale shall well and truly apply after paying the necessary expenses incidental to the due execution of this trust to the payment of the debts above set forth and described and the residue of any pay over to the said William R. Musgrave his heirs executors and administrators and it is here by further stipulated and agreed that until the sale of the property above set forth and described the said William R. Musgrave shall retain the possession of the same. In testimony whereof the said parties have hereunto set their hands and seals the day first above written.
