Rhodes, Sheriff to W. H. H. Cobb Tract in Everittsville Wayne County Deed Book 28, p 506-507 This Indenture made on the 3rd of February one thousand eight hundred and sixty nine between John C. Rhodes Sheriff of the county of Wayne and State of North Carolina on the one part and W. H. H. Cobb of the county of Wayne and State of North Carolina on the other part Witnesseth that whereas by virtue of an execution issued from the Superior Court of the County of Wayne in the name of Joseph R. Hatch Plaintiff against B. W. Cobb defendant for the sum of five hundred sixty four 28/100 dollars which said sum was recovered by the said Joseph R. Hatch in said court as decreed may appear and whereas the said execution was directed and declared by the said John C. Rhodes high Sheriff as aforesaid commanding him that of the goods and chattels lands and tenements of the said B. W. Cobb he should come to be made the aforesaid sum of five hundred sixty four 28/100 dollars to satisfy the said execution with the cost thereon and the said John C. Rhodes Sheriff as aforesaid in pursuance and by virtue of his office and the aforesaid execution did seize and levy upon these several pieces or parcels of land situate lying and being in said county of Wayne bounded as follows: one tract on the south side of Neuse River adjoining the lands of Matthew Casey, J. P. Cobb and others on which the late W. B. Cobb residence containing 1200 acres more or less; one tract in Everittsville adjoining the lands of Mrs. W. B. Hollowell and others on which W. H. H. Cobb now resides containing 4 acres; one tract on the south side of Falling Creek adjoining the lands of Irvin King the heirs of John Cogdell and others formerly owned by Mrs. Ann S. Cobb containing 627 acres more or less. And the said John C. Rhodes Sheriff as aforesaid after due advertisement according to law did cause the said tracts or parcels of land with all the appurtenances thereunto belonging to be put up at public sale to the highest bidder on the 3rd day of February AD one thousand eight hundred and sixty nine at the Court House door in said county at which time and place aforesaid W. H. H. Cobb became the last and highest bidder at the sum of six hundred dollars for the said lands with the appurtenances therewith belonging. This Indenture therefore Witnesseth that the said John C. Rhodes Sheriff of Wayne County as aforesaid for and in consideration of the sum of six hundred dollars to him in hand paid by the said W. H. H. Cobb at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged he the said John C. Rhodes Sheriff doth hereby bargain sell convey and confirm unto the said W. H. H. Cobb his heirs and assigns forever all the rights titles claims interest or demand of the said B. W. Cobb in the aforesaid pieces or parcels of land with all the hereditaments and emoluments to the same belonging or in any wise appertaining to have and to hold to him the said W. H. H. Cobb his heirs and assigns in as full and ample manner as he the Sheriff is empowered by virtue of his office to convey and assure the same. And further the said John C. Rhodes Sheriff doth hereby covenant and warrant to the said W. H. H. Cobb his heirs executors administrators and assigns the rights title and interest in the said lands so far as his office of Sheriff will admit and no further. In testimony whereof, the said John C. Rhodes Sheriff of Wayne County hath hereunto set his hand and seal the day and year first above written. John C.
