McKinne, William Davis, Needham Jinnett and Isaac H. Cox lying on Neuse River and containing about fourteen hundred acres it being the same on which I now reside Also two acres of land in Everittsville Also two mules, two horses, three cows and calves, fifteen hogs, eighteen sheep, eight goats, one buggy, one one horse spring wagon, one two horse wagon, two carts, all my farming implements, all my household & kitchen furniture, all my corn about sixty barrels, twelve stacks fodder, in fine all my tangible property of every description In the special trust and confidence, nevertheless, that the said Richard Washington sell said property publicly or privately on credit or for cash and on such terms as shall seem to him most advantageous to the creditors herein after mentioned and after paying or retaining the costs, charges, expenses and commissions incurred or due in and about the execution of this trust, that he shall apply the balance to the payment of the following claims pro rata Viz: One note given and due to Richard Washington for $537.81 due the first day of August 1860 Also one note given to Andrews & Washington which is now the property of Richard Washington for $538.25 due the 1st day of July 1862 Also one note given by me to Richard Washington with John Everitt security due & dated the 5th January 1865 for $432.35 After paying all the foregoing claims the said Richard Washington shall apply any balance on hand to the payment of the following debts pro rata, Viz: A note given by me to William B. Edmondson Admr of John Wright dec'd for $2675 on which there is a credit of $2097.66 the 15th of October 1866 which note is now the property of John Taylor Also one note given by me to James A. Howell with Richard Washington security due 5 January 1865 for $381.47 And after all the aforesaid claims shall have been fully paid that the said Richard Washington shall apply any balance on hand to the payment of the following pro rata, Viz: One note given by me to Tabitha Sims for $261.14, Geo. W. Collier security due 20th November 1860 One other note given by me to Charles F. Dewey for $1003.24 payable in specie due 1st October 1866 One ditto to William Becton due 17th Augt 1862 for $593 subject to a credit of $100 date of credit not collected One other note to W. A. Avery for between $200 & $300 given in the year 1862 One note to Irvin King for $41 due 15th January 1862 One ditto to Jesse Benton for $125 due 7th Decr 1866 One ditto to James Knight due 9th June 1861 for $169.48 One ditto to John Cox for $72.65 due 20th February 1866 One ditto to John Everitt Guardn to the heirs of John W. Sasser for $2108.44 due 11th August 1857 One ditto the same as Guardn to the same for $423.15 due 1st Jany 1858 One ditto to John Everitt for $275 due 21st February 1861 One ditto to Waitman Thompson for $637.76 due 21st August 1861 One ditto to the same for $600 due 5th July 1862 One ditto to Kichen Cogdell for $16 due in 1861 After paying all the aforesaid debts that the said Richard Washington shall pay any balance remaining to the said Saml Smith or his personal representatives.
