Wayne County, NC - John Stanly & Moses Mordecai to John Atkinson, 1829 ~~~~~~~~~~~~~~~~~~~~~~~~~~ This Indenture made and entered into the twentieth day of February in the year one thousand eight hundred and twenty nine between John Stanly of the County of Craven and Moses Mordecai of the County of Wake of the one part and John Atkinson of the County of Johnston of the other part Witnesseth that the said John Stanly and Moses Mordecai for and in consideration of the sum of eleven thousand dollars to them secured to be paid at and before the ensealing and delivery of these presents by the said John Atkinson have given, granted, bargained and sold, aliened, released, enfeoffed, and confirmed and by these presents do give, grant, bargain and sell, alien, release, enfeoff and confirm unto the said John Atkinson, a certain tract or parcel of land situate in the County of Wayne in the part of North Carolina, on both sides of Richland Swamp, bounded as follows: Beginning at a large black gum, Benjamin Bests corner in Holmes's pocoson, by the Bee Tree, running thence North thirty five degrees East eighty pole to a small blased pine, the dividing corner made between Daniel Croom and Charles Croom, now Benjamin Bests corner, then with his line of marked trees North twenty two West sixty two poles then North twenty West one hundred and seven poles, then North twenty West forty four poles to the road, then along the road North seventy nine West twenty two poles, then West twenty poles then South seventy nine West forty poles to Benjamin Bests corner on the road then with his line South fourteen East twenty one poles to a persimmon tree in the head of Small Branch then down the run of said Branch as it meanders to a bunch of maples at the mouth thereof said Bests Corner, then up the run of Richland Swamp as it meanders about eighty pole on a strait line to where the patent line crosses the run of Richland Swamp then with the old patent line South forty four West sixty poles to a red oak (down) the old corner of the patent then South forty eight West two and three quarter poles to a pine thence North forty six West four and a half poles to a post oak by the side of the widow Crooms fence then South fifty three and a half West one hundred poles to a stake then South sixty one East five hundred and twenty five poles to a stake in the back line of the Wiley Croom tract then with the line of said Wiley Croom tract North ninty East two hundred and forty seven poles to a red oak (down) on the road, then West one hundred and five poles to a large pine and stake, then North thirty five West one hundred and thirty four pole to a stake and pine, then North one hundred pole to a pine, then West forty poles to the corner, then North forty five West eleven poles to the corner, then South forty West twenty seven poles to the corner then South seventeen East nineteen poles to the corner then South fifty five East forty one poles to a pine then South thirty five West twenty poles to a pine, then North eighty six West one hundred and thirteen poles to the first station containing one thousand acres To have and to hold the said tract of land with its appurtenances to the said John Atkinson and his heirs for ever And the said John Stanly & Moses Mordecai for themselves their heirs executors and administrators do covenant with the said John Atkinson his heirs & assigns that the estate in the said tract of land is free from any incumbrance or charges made or caused by them or either of them save only that divers tenants have rented & are inbilled to occupy a part of said lands for the present year the rents from whom as they may become due are hereby assigned to the said John Atkinson; and that the said John Stanly and Moses Mordecai will warrant & defend the title to the said land against all others claiming or to claim by from through or under them the said Stanly and Mordecai or either of them unto the said John Atkinson his hiers & assigns and will also defend the same against the lawful claims of any and all persons whatsoever In witness whereof the said Stanly & Mordecai have here unto set their hands and seals the day & year first above written Signed Sealed & delivered J.
