Hudson and wife Mary Hudson Source: www.familysearch.org Wayne Deed Records 1882-1884 Image 719 of 762 Microfilm of Book 51 of 532 Mortgage Deed State of North Carolina Wayne County The indenture made the 3rd day of Nov 1883 between Council Warrick of the first part and C.J. Hudson and wife Mary Hudson of the second part all of the county of Wayne and state of North Carolina. Witnessed that said Council Warrick for and in consideration of the sum of five dollars to him in hand paid the receipt of which is hereby acknowledged hath, bargained, sold and conveyed and by these presents doth bargain, sell and convey unto said C.J. Hudson and wife their heirs, executors, administrators and assigns two certain tracts or lots of land lying and being in the county of Wayne and the state of North Carolina bounded as follows being tracts of land lying on the North side of Falling Creek in said Wayne county adjoining the lands of Nathan Byrd, C.C. Byrd, Alex Grantham, Daniel Brock, James Warrick and others containing one hundred and thirty acres more or less being the same land this day conveyed to the said Council Warrick by C.J. Hudson and Mary Hudson by deed to secure the payment of which this mortgage is given to have and to hold the aforesaid tracts of land to this the said C.J. Hudson and wife their heirs and assigns forever the condition of the foregoing obligation is that whereas this before execution Council Warrick is justly indebted to said C.J. Hudson and wife in the sum of seventeen hundred dollars due by 6 notes and due Jany 1st 1885, 1886, 1887, 1888, 1889, 1900 dated here with is honestly devisors of securing the payment of the same now therefore if the said Council Warrick shall payoff and discharge said debt when due then this deed and every part thereof shall be void and of not effect otherwise to remain in full force and virtue and it is for this understood and agreed that in case the said Council Warrick shall fail to pay off said note when due then the said C.J. Hudson and wife is authorized and empowered to advertise the said land at the court house door and three other public places in Wayne county for thirty days and after such advertisements sell the same for cash at the court house in Goldsboro and convey the same deed to the purchaser and out of the proceeds of such sale pay the debts and all necessary expenses of working and executing this trust and the balance remaining (if any) they shall pay over to the said Council Warrick or his legal representatives. In witness whereof the said Council Warrick hath hereunto set his hand and seal this the 3rd of Nov. 1883. Council x Warrick Witness: J. F.
