M. Warrick and Elizabeth Warrick of the first part and Mary Hudson of the second part of the county Wayne Sate of North Carolina. Witnessed that said parties of the first part in consideration of five dollars to herein paid, the receipt of which is hereby acknowledged have bargained and sold and by these presents do convey unto said party of the second part and her heirs a certain tract of land lying in Grantham Township Wayne County in said state bounded as follows: Beginning at a black gum on the main run of Falling Creek A.A.. Grantham's S.E. corner and runs with his line N9# 150 poles to stake near the graveyard then S813E 4 poles to a stake then N9E 6 poles to stake then N81N 4poles to stake A.A. Grantham line then with his line N9E 53 poles to a stake THEN n80e 28 POLES TO STAKE THEN n40e31/4 POLES TO STAKE ON THE ROAD THEN ALONG SAID ROAD n62w 16 POLES TO SWEET GUM IN SMALL BRANCH THEN UP A BRANCH TO A SMALL PINE w. b. Hood's corner then S82E108 poles to pine stump then S21W 62 poles to a dead pine stump and then S7E 16 poles to two hollys on run of McCullen branch then down over run to a sweet gum James McCullen's corner then with his line S52W to poles to a stake then W 5poles to a stump S52W 164 poles to a water oak on run of Falling creek then N65W 94 poles to small post oak then S64W 31 poles to a main run of Falling Creek at the fishing hole then up said creek run to beginning containing 274 acres more or less. To Have and to hold the aforesaid tract of land to said party of the second part her heirs, executors administrators and assigns that they are seized of said premises in fee that the same are free from all encumbrances and they will warrant and defend said title of the same against the lawful claims of all persons. The condition of the deed is that whereas the said parties of the first part and justly indebted to said party of the second part the sum of sixteen hundred dollars by 3 notes bearing interest at 8% the first note for $500 and due January 1, 1893 the 2nd for $500 and due January 1, 1894 and the 3rd note for $600 due January 1 1895 date herewith and is and honestly desirous of securing the payment of the same. Now therefore, if the said parties of the first part shall pay off and discharge said debt when due and the interest accruing thereon, then this deed shall be void. And it is further understood and agreed that in case the said parties of the first part shall fail to pay off either one of the said notes and interest, when due then all notes to become due and payable at once and the party of the second part or her assigns is authorized and empowered to advertise said land at the Court House door and there other places in Wayne County for thirty days and after such advertisement sell the same for cash at the Court House door in Goldsboro and convey the same deed to the purchaser and out of the proceeds of such sell pay the said debt and all necessary expenses of making and executing this trust and the balance remaining shall be paid over to said parities of the first part or their legal representatives. Warrick and Elizabeth his wife personally appeared before me this day and acknowledges the due execution of the annexed deed and the said Elizabeth Warrick being by me privately examined, separate and apart from her husband touching her voluntary execution of the same doth state that she signed the same freely and voluntarily without fear or compulsion of her husband or any other person and that she doth still voluntarily assent thereto.
