Wayne County, NC - Penelope Warters to Elisha Uzzell, 1860

This indenture made on the 20th day of December, one thousand eight 
hundred and sixty, between PENELOPE WARTERS of the county of Wayne and 
state of North Carolina on the one part and ELISHA UZZELL of the county 
and state aforesaid, on the other part, Witnesseth, that the said 
PENELOPE WARTERS for and in consideration of the sum of seven hundred 
dollars, to her in hand paid by the said ELISHA UZZELL, at the time of 
executing these presents, the receipt whereof is hereby acknowledged, 
hath granted, bargained, sold & conveyed and by these presents doth 
grant, bargain, sell and convey unto the said ELISHA UZZELL, his heirs 
& asigns, my life estate or dower, which will more fully appear by 
reference to the division of the land of my husband NEEDHAM WARTERS 
dec'd a certain tract or parcel of land in the county of Wayne, situate 
on the waters of Walnut Creek, adjoining the lands of JOHN WOOTEN, 
FRANKLIN WHITFIELD, NANCY BIZZELL& HENRY BIZZELL, containing by 
estimation three hundred and fifty acres (350) be the same more or less 
to have and hold the above described lands & premises & every part & 
parcel thereof with all the privileges, appurtenances thereunto 
belonging to him the said ELISHA UZZELL his heirs and asigns during my 
natural life to their own proper use and benefit & behoof, and the 
aforesaid PENELOPE WARTERS doth covenant and confer my life estate in 
the above described land, to ELISHA UZZELL his heirs and asigns free 
and clear of all encumbrances whatever during my natural life and I 
furthermore warrant and defend the title of the aforesaid land to 
ELISHA UZZELL, his heirs and asigns during my natural life, as witness 
hereof I have thereunto fixed my hand and seal the day and date above 
written.
