Collier Petition to sell 3 ½ acres Wayne County Deed Book 23, p 368-370 State of North Carolina Wayne County This indenture made and executed this the twentieth day of December AD 1852 between John W. S. West of the county of Wayne and state of North Carolina of the first part and George W. Collier of the same place of the second part, Witnesseth that whereas the said J. W. S. West in his own right and also as the guardian of John W. West, Probert C. West, Robert M. West, Mary S. West, Sarah West, Joseph G. West, infant children of the late Eliza West together with a certain Richard West exhibited their petition before the court at Equity for the county of Wayne aforesaid at fall term 1852 of said court praying for the sale of a certain tract of land of which the piece or parcel hereinafter described and conveyed is a part and whereas at said term of said court it was among other things ordered by the said court that the lands described in said petition be sold by the said J. W. S. West either at private sale or by public auction for cash or on such credit as the said J. W. S. West might consider best, and in such parcels as he might deem most judicious and that upon the receipt by said John W. S. West of the proceeds of the sales of said lands or of any part thereof the said J. W. S. West is authorized and empowered and appointed to make title to the purchaser or purchasers for the portion of said lands respectively purchased and paid for by them and whereas in pursuance to the provisions of said order and decree of said court of Equity the said J. W. S. West has bargained and sold by private contract to the aforesaid G. W. Collier for the sum of two hundred and fifty dollars all that portion of land described in said petition which is hereinafter particularly described namely a certain tract piece or parcel of land lying and being in the county of Wayne on the east side of the Wilmington and Raleigh Rail Road and bounded as follows, Beginning at W. D. Cobbs corner in Jesse Newells line and runs west with said Newells line to the line of the aforesaid R Road then with said line of said R Road north to D. B. Everitts line then east with said Everitts line to the corner of the maison lodge lot then with line of said lot to the beginning containing three and a half acres be the same more or less now therefore this indenture further Witnesseth that the said J. W. S. West by virtue of the authority power and appointment conferred on him by the order and the decree of the court of Equity of the county of Wayne referred to in the premises and by virtue of every other power and right him hereunto enabling for and in consideration of the aforesaid sum of two hundred and fifty dollars to him in hand well and truly paid by the aforesaid G. W. Collier at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged and the said J. W. S. West therewith satisfied content and paid has given granted bargained and sold conveyed and confirmed and by these presents does give grant bargain and sell convey and confirm unto the said G. W. Collier his heirs and assigns the tract piece or parcel of land herein before particularly described together with all and singular the rights privileges and appurtenances to the same belonging or in any way appertaining. To have and to hold the before described tract piece or parcel of land with all and singular the rights privileges and appurtenances to the same belonging or in any way appertaining unto the said G. W. Collier his heirs and assigns to his and their only proper use benefit and behoof forever and the said John W. S. West for himself his heirs executors and administrators hereby covenants with the said G. W. Collier his heirs and assigns that the before described and conveyed tract of parcel of land is not encumbered by reason of any mortgage judgment executor limitation or by any encumbrance whatever created by him the said J. W. S. West and that no act has been done or suffered to be done or left undone by him the said J. W. S. West by which the title of the said G. W. Collier the said lands and premises can or may be charged altered or defeated and that he the said J. W. S. West shall and will warrant secure and forever defend the said before described and conveyed land and premises unto the said G. W. Collier his heirs and assigns clearly freed and discharged of and from the lawful claims and demands of all and every person or persons whatever claiming or hereafter to claim said land and premises by through or under him the said J. W. S. West. In testimony whereof the said John W. S. West hath hereunto subscribed his name and affixed his seal the day and year first herein before written. J. W. S.
