Chambers Edward Griswold Plaintiff vs. John Lynch Defendant The Plaintiff complaining against the defendant alleges: 1st That on Monday the 4th day of May A.D. 1874, at and in the Town of Goldsboro, in said County, an Election was duly held, according to law, for a Mayor of said Town and for two Commissioners in each of the Wards in said Town = That said Town is divided into three wards, known respectively as the First, Second, and Third Ward 2nd That at said Election the plaintiff and this defendant were candidates for the office of Commissioner in said Third Ward: 3rd That said Election was held under the supervision of one N.B. Harris and one John Day, who were duly appointed by the Commissioners of said County "Inspectors of said Election" & one I.A. Washington, JP registion 4th That at said Election there were deposited in the ballot box designated to receive the votes for Commissioner in said Third Ward for the said Plaintiff, as such Commissioner, Eighty one (81) legal votes which were counted for said plaintiff by said registron & said Inspectors at the door of the poll on said day, and for the said box eighty (80) legal votes for said defendant as such Commissioner which were there and then counted for him by said Inspector and said registron 5th That in said box during said Election, were deposited for the said defendant as such Commissioner two (2) votes which said votes at the close of said poll, were reported by said Inspector as illegal and were thrown out from said count: that the said votes were rolled up together and were placed in said box by one and the same person. 6th That immediately upon the close of the poll of said 4th day of May, the said plantiff in the presence of said Inspector and said defendant was publicly proclaimed duly Elected Commissioner for said Third Ward and the result of said Election to wit: that the said plaintiff received Eighty one (81) votes for said Office, and the defendant Eighty (80) votes for said office there and then publicly announced. 7th That afterward to wit: on the 6th day of said May the said Inspector Counted the two (2) votes as aforesaid for the defendant and declared him elected, & on the 7th of said May executed ___ ___ ___ to said defendant a certificate that he the said defendant at the Election aforesaid had been duly elected to the Office of Commissioner of said Third Ward. Whereas plaintiff declared ___ against said defendant. That defendant surrender up said certificate of election to a ___ that plaintiff be declared duly elected to ___ to said office and ___ Dortch & Son & ____ Attor Ed Griswold, the plaintiff above named being duly sworn says that the ___ in bringing complaint a ___ the ___ Ed Griswold Sworn to & subscribed before me this 7th day of May 1874.
